House votes to restore abortion rights, Senate odds dim

WASHINGTON (AP) — The House has voted to restore abortion rights nationwide in Democrats’ first legislative response to the Supreme Court’s landmark decision overturning Roe v. Wade.

The bill has little chance of becoming law, with the necessary support lacking in the 50-50 Senate. Yet voting marks the beginning of a new era in the debate as lawmakers, governors and legislatures grapple with the impact of the court’s decision.

The legislation passed 219-210. The House was also voting on a separate bill to prohibit punishment for a woman or child who decides to travel to another state to get an abortion.

Democrats have highlighted the case of a 10-year-old girl who had to cross state lines into Indiana to get an abortion after being raped, calling it an example of how the court’s decision is already having severe consequences.

Meanwhile, the Democratic National Committee has already launched a digital ad campaign to energize voters on the issue, warning that Republicans’ ultimate goal is to outlaw abortion nationwide.

“We have to elect a couple more Democratic senators so that we can get around the filibuster so that we can pass legislation that truly impacts a woman’s right to choose,” she said. “There’s no halfway measure.”

Does the bill cite the ‘commerce clause’ to justify Federal involvement? Are many abortions performed interstate?

Or is it the ‘general welfare’ clause?

So, the allowable standard will vary by state but there will be a minimum standard? Will Mississippi’s standard pass muster? Or will California’s standard apply to all states?

There won’t be much clarification of this bill in the MSM and how the Democrat representatives voted because it could be uncomfortable for some of them.

The feds cannot make a law that says that the states cannot make a law against something.

The feds can make a law that criminalizes something, in addition to any state laws about the same thing.

The founding fathers intended for the federal government to be a loose federation of states, banded together to provide for the common good, to maintain one army and one currency -— not to become a fascist dictatorship overpowering all the states.

A 219 to 210 margin is not enough to pass a constitutional amendment in the House. SCOTUS found there was no federal constitutional right to an abortion in the US Constitution. Merely passing a statute in does not give the federal government the power to create a federal constitutional right.

They did. This is Pelosi, Schumer, etc.. stirring up the crazies and attempting to create an election issue.

The crazies are gonna feel real stupid when the USSC slaps down any "law" creating a right out of thin air, that the FedGov has no business in doing.
