Does the same standard apply to, say, slavery?
That’s a completely different issue. The Emancipation Proclamation basically outlawed slavery for those states that stillchad slaves. Congress then acted to codify that with legislation. That legislation also is how the feds are able to crackdown on sex trafficking which is a form of slavery. To answer your question though, I guess in general if a person subscribes to support the Constitution and States rights I suppose there’s an argument for a state to endorse slavery. Would that happen in the USA today? Certainly not. Do I support slavery? NO. do I endorse abortion? NO. It all boils down to a states rights issue for me. This issue was brought to the voters, they endorsed it so if I lived there and didn’t like that I’d move to a more friendly state to my ideals.
Does the same standard apply to, say, slavery? If so, then you need to ask the same about direct election of senators, women's franchise, voting age of 18, and due incorporation of due process/equal protection.
Not since we passed an amendment, no. Before that, yes.
Our Constitution has a specific amendment banning slavery. I think the Supreme Court was saying that our Constitution is silent on abortion, so it should be up to the states.
Lol… you did not go there. Great post.
