Unconstitutional security state targets Trump
Washington Times ^ | Judge Andrew Napolitano

Posted on 08/25/2022 10:00:42 AM PDT by TBP

Former President Donald Trump will soon be indicted by a federal grand jury.

He is the victim of a federal government that knows no bounds and has assumed powers nowhere granted in the Constitution by the sheer force of its own will. It has created a security state, replete with three lettered acronymic-named agencies — FBI, CIA, DEA, NSA, DIA — that are nowhere recognized in the Constitution, regularly break the written and moral laws, and are themselves far more dangerous to human freedom than the folks they pursue.

How many laws have the feds broken? Ha. No one knows how many criminal laws Congress has enacted. Estimates range from 4,400 to 5,500. How can this be? For starters, members of Congress in both parties rarely if ever read the legislation they enact. House members were given 15 minutes to read the 132-page Patriot Act, which passed overwhelmingly. And much federal law is so convoluted that a simple reading leaves even an experienced lawyer and judge bewildered as to how many different behaviors were made criminal by the statute in question.

Yet, nearly all federal criminal laws — including those now confronting Mr. Trump — are wildly unconstitutional. That’s so because the Constitution only authorizes the feds to enact criminal statutes in two areas — criminalizing treason and debasement of the money supply. All remaining criminal laws — those that are intended to protect life, liberty and property, even those intended to protect government assets — were intended by the drafters of the Constitution to be addressed by the states.

Judge Napolitano is no Trumper. He's been an oppoenent of Trump and supported impeachment. He even criticizes President Trump in this article. But he's a defender of the Constitution and he understands how President Trump's rights have been violated.

Once there is a case filed against him, Trump will file for suppression and dismissal. It is a fatally flawed case,

Anything taken for this search is FRUIT OF THE POISONOUS TREE and INADMISSABLE AS EVIDENCE because illegally obtained from an unconstitutional search that violated a show of PROBABLE CAUSE as required by the 4th Amendment.

This tactic is to tire out the base. They want us to be worn out. This is a battle we have to win! Stand firm for our commander-in-chief President Trump! We don’t need weasel spineless conservatives we need strong brave top gun Patriots!

nah

they didnt go there to collect evidence for a court case

they want to bury evidence against them in an “ongoing investigation”

plus see his lawyer-client docs

the raid will produce countless leaks

You got that right Sister! Anger gets me started and more active to see that MAGA wins the day because we know the Democrats are possessed, Republicans are spineless and we need to get rid of all of them......amen.

Anyone in the “base” with weariness capability is definitely NOT IN THE BASE.

The beginnings of the infamous Soviet NKVD : Peoples Commissariat for Internal Affairs.

“Anything taken for this search is FRUIT OF THE POISONOUS TREE and INADMISSABLE AS EVIDENCE ...”

Only if a judge rules it is so, and if an indictment is filed, we know it will certainly be before a compliant Obama judge who will not find that this is so.

Perhaps, but the idea may simply be to cause a media circus by charging President Trump in D.C. before complaint Dem judges and try to get a trial before Trump hating D.C. jurors. I doubt it would stand, but the idea appears to be to damage him politically at least in the short term. Imagine all of the RINOs in the House refusing to back Trump for Speaker because he gets indicted. It's not hard to do, as they will use any excuse to bail on that plan.

Anything taken for this search is FRUIT OF THE POISONOUS TREE and INADMISSABLE AS EVIDENCE because illegally obtained from an unconstitutional search that violated a show of PROBABLE CAUSE as required by the 4th Amendment.

Well that used to be the law. Just remember it was people like Giuliani who worked to change those rules.

The 4th Amendment has not changed.

No, the text never changed, but its interpretation has varied. See United States v. Leon, 468 U.S. 897 (1984) for how "conservative" justices have undermined it. I fully expect a D.C. court to conclude the FIB acted in "good faith" when they raided Mar-a-Lago.

Unconstitutional Court decisions do not trump the Constitution as written and originally intended and understood (Art. VI., Cl. 2).

Can things taken that are not listed in the warrant be considered stolen property?

If it isn’t listed in the warrant and it’s possession isn’t an Illegal Act, then by definition it is ARMED ROBBERY.
