Of course not. But CNBC was careful to phrase it as "conspired to steal items from Florida and transport them over state lines". Not diaries.

They have to get the slant on their bias juuuuuust right.

While that is true and that’s how they shopped it around to people, apparently they plead guilty to stealing it.

No- it is a crime. Crossing state line to illegally enter the country is not a crime.

Does that qualify as abandoned property?

If someone leaves a bicycle in front of a store front, it’s not considered abandoned property even if it’s not chained.
You take it and it’s theft.

By the same token, I suspect, a diary left in a hotel room, still belongs to the owner. And the proper course would have been to turn it into the hotel, and let the hotel contact the owner.

Unlike Hunter’s PC, where I believe the contract specified that equipment not picked up in a certain time frame became property of the repair shop. And the repair shop was implicitly granted rights to view the PC, and upon finding evidence of crimes committed, has an obligation to turn it over to law enforcement, and make a copy for Rudy.

I noticed, they pled guilty, so I’m guessing their lawyer told them taking the diary qualified as theft.

I know. “Transporting a diary across state lines” is a crime? Good Lord, we are in a world of hurt. This is more of the FBI and other agencies doing Biden’s bidding and sending a warning to every other American “Don’t mess with us.”
