It isn’t the court that’s after him, it’s the parents he defamed.

Sometimes free speech has consequences.

That’s the part that is hard for people to keep in mind.
It is happening in a court room, so people think it’s the government doing it, but if it’s a civil suit and not criminal prosecution, then it’s brought by people, not the government, and not protected by the first amendment.

However, that’s not all black and white. Why is it that the press and “news” organizations can basically outright lie, and they DO seem to get protections by the court? I have heard that defamation is harder to win if it’s against the press, because they have some kind of protections. In a civil suit that shouldn’t matter, should it?

I’m not rooting for an ever increasing litigious society, but I believe Sandman successfully sued some “news” organizations, so there are examples you can sympathize with.
