Supreme Court keeps in place Trump-era immigration policy allowing asylum-seekers to be quickly turned away

WASHINGTON — The Supreme Court on Tuesday allowed Title 42 — a Trump-era immigration policy implemented when the pandemic broke out to quickly expel asylum-seekers at the border — to remain in effect for now, putting a judge’s ruling that would have ended it last week on hold.

The court voted 5-4 to grant an emergency request by 19 Republican state attorneys general who sought to intervene in defense of the policy. The decision puts on hold a ruling by Washington-based U.S. District Judge Emmet Sullivan, who said the Centers for Disease Control and Prevention’s implementation of the policy was “arbitrary and capricious.” Sullivan’s ruling was due to go into effect Dec. 21.

Conservative Justice Neil Gorsuch joined the three liberals on the court in voting against the stay request. The brief court order said that while the administration cannot set aside the Title 42 policy, the decision "does not prevent the federal government from taking any action with respect to that policy."

The Supreme Court also agreed to hear oral arguments in February and rule on whether the states can intervene, with a decision due by the end of June.

The court's intervention averts what many had predicted would be an additional surge of people seeking to enter the United States at a time when border crossings are already high. Without the policy in place, people seeking asylum would be able to enter the U.S., where they could be waiting for years for a court date if they pass their initial interview with authorities.

Gorsuch is a “moderate”. Not reliable either way.

So will FJB and Co abide by something as trifling and trivial as a SCOTUS decision?

They aren't doing that now so why would they change?

How about removing all illegals now in the US? As a start, rescind all work permits and implement eVerify. Both steps will help clear out many, then put bounties on the rest—Maybe offer amnesty to employers, plus $500 reward for each illegal alien they have in their employment—turn them over for deportation. Give US citizens $1,000 each for every illegal they can out at their employer.

Bidens little inexperienced $hit stirrers will find way to keep the southern freeway border in free flow. They have no real world experience but they can write the weasel words into anything, making it something else.

You can read these Supremes like a book nowadays. You just knew Gorsuch was a squish, not that there’s anything wrong with that, and still better than anyone appointed by W in my opinion. Kav was obviously a major threat to the dems, hence the made-up stories and hail m_ry play against him. But This is what winning looks like. Trump’s presidency continues to bear fruit.

I agree. The way it reads the Biden admin still can simply ignore it.

Folks, do we ever want presidential orders to ever be able to be stopped by a president? The answer is “yes.”

I want Donald Trump to undo the presidential order that allowed government unions. I also want him to rescind all Biden crud.

Don’t you?

This should only stay in place if some alternate reasoning can be made, such as a lack of alternative to guarding the border, some state reasoning that the Constitution says overrides this stupidity, or something else.

We ALL want Biden’s changes to get undone!

A law is only as good as the ability to use actual violence to enforce it.

The Executive branch will not point a gun at itself and threaten to throw itself in jail if it does not comply ...

Sounds like Gorsuch needs a busload of illegals dumped in his neighborhood.

Better yet, give US citizens $10,000 each for every illegal they can deliver to the border. That’s far, FAR cheaper than feeding them, providing them housing, medical care, schooling for the kids, welfare, etc.

But it’s still the law, and the executive branch is there to enforce the law. This forces them to do so. If they don’t, then Biden or Willie’s side piece or Newsome or whoever will be hurt. We still have to figure out the ballot thing of course, which I believe we will.

Seems Gorsuch is more of a moderate than Kavanaugh and ACB lately, which surprises me.
