The income tax portion would be struck down as unconstitutional and what would we be left with? An income tax AND a "consumption" tax!!!

I see where congress has the power to tax income, but I don't see where it is mandatory for them to do so.

I don't see where they have the power to tax consumption.

The power to tax income is due to the 16TH amendment. The last time I looked at it, the Fait Tax plan is to repeal it before the Fair Tax can be implemented. If repeal fails, the Fair tax is not implemented.
