Having drafted and argued numerous Motions for Summary Judgment, I can say this Motion is a loser. The basic rule is that if all the facts that the non moving are deemed true, does the non moving party have a tenable claim. Here, Fox is arguing numerous facts which is contrary to the basis for a summary judgment and is best saved for trial. In fact, the easiest way to defeat a MSJ, is to toss in disputed facts the support a legal claim.
Some law firm made a lot of money on this monstrosity of a motion.

If Fox, Mike Lindell, etc. lose their cases and history eventually revels the election WAS stolen will those wrongly punished be re-compensated? Which won’t make up for the anguish and lost life-time. Such is happening on the Corona vaccine purges now.

It's a part of the full lawyer employment crap that infests the legal system.
