Former Judge Accuses DeSantis of Violating the U.S. Constitution

Florida Gov. Ron DeSantis is being accused of violating the U.S. Constitution and Florida law by former Judge and Fox News Contributor Andrew Napolitano.

Judge Napolitano made the accusation against Gov. DeSantis on Twitter and Tik Tok after a video was posted by conservative activist and journalist Laura Loomer showing herself and a group of Trump supporters from TheVillages being told to leave the parking lot of the bookstore where DeSantis was having his book signing event.

“That’s absolutely prohibited by the Constitution of the United States. Moreover, Florida has a public accommodation law,” said Napolitano.

After posting the video on his Twitter and Tik Tok accounts, Napolitano continued, saying that Florida law does not allow for anyone to be discriminated against “on the basis of their politics.”

“You cannot discriminate against people on the basis of their politics. That’s Florida law. So, the Governor, or his people, he’s going to claim he didn’t know about it, directly or indirectly violated the Constitution he swore to uphold, the First Amendment he swore to uphold, and Florida law he swore to enforce,” concluded Napolitano.

Loomer posted the video on Twitter, accusing Gov. DeSantis and his staff of being ignorant of the U.S. Constitution and Florida law.

The incident occurred Tuesday, February 28, 2023, on the first day of DeSantis's book release, during a stop on his book tour at Books-a-Million bookstore in Leesburg, Florida.

Loomer, who supports former President Donald Trump’s 2024 presidential candidacy, has been relentlessly attacking DeSantis over what she calls his "failed" Big Tech censorship bill and his recent encouragement of the Florida Legislature to change Florida's “Resign to Run” las so that he can keep his job as govenor, and primary challenge President Trump in 2024.

That measure to change the "Resign to Run" law is expected to make its way through the Florida Legislature when session begins next week.

In the viral video she posted of the incident, a security guard is seen and heard telling Loomer and her group to leave.

“The (Team DeSantis) told me that anyone wearing Trump has to go right now, during the signing,” said the security guard.

The guard continued, saying, “DeSantis people are in there saying, to have me come and tell you guys not to be here while he’s here.”

Loomer asked, “So DeSantis’s people told you we have to leave?”

The guard responded “Yes.”

The Floridian spoke to the DeSantis team and they reassured us that they did not tell the guard to tell Loomer and the rest of the Trump supporters to leave, even though the secruity guard is on video repeating the accusation several times.

DeSantis’s team had no further comment.

DeSantis will be in Texas this weekend speaking at events in Dallas and Houston (for a Club for Growth Club Meeting), and will not attend CPAC, as The Floridian first reported.

Thank you @Judgenap for shedding a light on @GovRonDeSantis & his staff’s ignorance of the US Constitution and their violation of Florida’s Public Accommodation laws. You’re spot on.

I don’t want a President who is ignorant of what’s inside the US Constitution & FL law.

Well, he’ll be absent from Fox from now on, considering they’re 100% backing DeSantis. Must not criticize DeSantis.

If I was to wear a MAGA hat to a DNC convention in Miami Beach, I would be escorted out.

Trump supporters can walk in to a public place, but they can’t proselytize by any means.

If a gay man attempts to pick up a young boy at any store I would own, he would be shown the door.

DeSantis is supposedly an anti-woke MAGA conservative, and he hasn’t declared. Why would he oppose a Trump shirt or hat at a DeSantis book signing? Aren’t we all on the same team?

This guy didn't lay the blame on the Governor, but on his “people.”

Maybe his people did; but maybe somewhere for political purposes this thing has gotten misconstrued like that “perfect phone call" got misconstrued.

Especially since that former judge is Napolitano.

If DeSantis supporters showed up to a Trump event of this type waving signs, you know that Trump would have rightfully had them tossed out.

Got to hand it to them, however - they did create a spectacle that can be used against DeSantis by changing the context of what the actual optics were. A bit deceptive, but still a genius move.

If Trump for any reason can’t be the nominee then DeSantis will be the next man like George Armstrong Custer and Donald Trump to wear an arrow shirt.

Club for Growth, Karl Rove, the Bushes, Napolitino, and all the usual GOP “go along to get along” players are promoting DeSantis. That makes me hesitate to trust him.

However, this is a nothing-burger. If DeSantis or the venue wanted certain people at his event, then they had the right to tell others to leave. It’s much like Trump rallies when agitators appear and try to cause trouble. They are, and should be, escorted off the premises with no objection from Trump supporters.

The media’s insistence in creating or amplifying any divide between Trump and DeSantis is obvious to any that are paying attention. Just ignore that noise. The left wants to crush all support for the GOP by creating a “divisive” narrative. They do it all the time and the right falls for it repeatedly.

I am sure all the DeSantis bots on this site can find a way out of the impasse for DeSantis — his heart being so pure, being the special 8th day creation of God and all, and it was his people, certainly not him. Impossible.

I often agree with Judge Napolitano and I admire his knowledge of and dedication to the Constitution, but his personal views sometimes get in his way.

If this was a permitted event, then DeSantis can do whatever he wants (pretty much.) Public accomodations laws don’t apply. I’ve been removed from public spaces because ther ewas a permit and the permit holder didn’t want people like me there.
