ACLU files lawsuit against Saucon Valley School District over After School Satan Club (Pennsylvania)

The American Civil Liberties Union has filed a lawsuit against the Saucon Valley School District for not allowing the After School Satan Club to meet in a district school.

The lawsuit, filed Thursday in U.S. District Court for Eastern Pennsylvania, was expected; the ACLU last month threatened legal action against the district for violating the club’s First Amendment rights, if it continued to prevent the club from hosting meetings.

“The Saucon Valley School District’s decision to cancel the After School Satan Club in response to public opposition sets a dangerous precedent,” Sara Rose, deputy legal director of the ACLU of Pennsylvania, said in a news release.

There should be a recognized distinction between clubs in school and speech/association in other public contexts, in that the purpose of allowing clubs in the school is not for speech/expression per se but for an educational activity. As such, the school must enjoy exclusive discretion over what clubs are appropriate for fostering the students’ education.

The school could argue that even though the IRS has granted it religious exemption, the Satanic Temple is not a religion, since it is 'Resolutely non-theistic, The Satanic Temple does not endorse supernatural (or “supernormal”) explanations... Once a "faith-based" secular group or secular parody org. is classed as a religion then it opens up a secular Pandora's box of orgs claiming religious exemption.
