It may be, but how are you going to prove it? You think her lawyers are going to break their attorney-client privilege to testify that she told them to do it?

Put enough pressure on the lawyers and they will spill or face ruin. Clinton's attorneys acted as not just advisers but as instruments of a criminal conspiracy in organizing the effort, paying the funds for it to Fusion GPS to generate the necessary falsehoods, and then pressing the FBI to investigate. That makes the attorneys criminally liable and voids the attorney client privilege. Find a capable, zealous prosecutor and a reliable judge and the whole thing can be broken open.
