Minutes ago, the Fifth Circuit Court of Appeals issued a preliminary injunction (download the PDF HERE) against the DOJ’s and ATF’s unconstitutional attack on firearms equipped with a pistol stabilizing brace. The lawsuit, brought by the Firearms Policy Coalition (FPC) and other plaintiffs, paid off with this temporary injunction just days before ATF’s mandatory registration “grace period” that was set to expire on the 31st.

“Don’t celebrate too soon, though! Unfortunately this temporary injunction applies only to the named plaintiffs . . . “…Preliminary Injunction Pending Appeal is GRANTED as to the Plaintiffs in this case.” It stays in effect — only for these plaintiffs — until an appeal in the case is ruled on. Stay tuned, because it’s at least a first real step and a first win, even if quite limited, in the right direction since the new ATF ruling was announced.”
However, this is a good sign!

Gun control is a steady hand and a beady eye.
I’m always encouraged when America’s side scores a win, no matter how small.
Thankfully, we have Andrew Clyde (R-GA) (owner of Clyde’s Armory) on our side and he is like a bulldog on this issue.
Great!
Now let’s repeal all the unconstitutional infringements which only serve to falsely criminalize millions of good Americans
And remember, atf Director Dingleberry said, during a House hearing, to Rep Massie (Ky), that all you have to do is to take the brace off of the pistol.
You can keep both and they won't charge you with constructive possession.
As if I believe that.

“Fifth Circuit grants injunction against ATF’s pistol brace rule”
“Still, this is an important development in the ongoing litigation, especially since the district court judge who was assigned to hear the case declined to grant injunctive relief, ruling that the plaintiffs were unlikely to prevail with their arguments that the new rule violates both the Second Amendment and the Administrative Procedures Act. “
There were something like 22 other states that had joined them in the lawsuit.
DOJ. What a joke.
“Fifth Circuit grants injunction against ATF’s pistol brace rule”
From the degenerate liars at the ATF...
“Myth ATF makes the gun laws.”
“False: Congress makes federal gun laws; ATF enforces them.”
Complete BS. They are just like all the other unconstitutional bloated bureaucracies. They make “rules” and enforce the rules without any say from congress or “we the people.”
Andrew Clyde won his primary in Georgia last year something close to 75% to 25% over the second place winner.
Then, in the general election he beat the democrat candidate much by the same margin to be elected to serve a second term in office. He is well-liked in the state and I do not see another candidate beating him in that district (reliably conservative) anytime in the near future.
Gun control is a steady trigger pull. 😉
Oh yeah. His district is NE of mine.
👍
Andrew Scott Clyde (born November 22, 1963) ....bummer of a birthday.
Yeah, I have a sister born on 11/22 as well, although a few years earlier than Rep. Clyde. I heard the story for years of how her birthday celebration was forgotten. For quite some time her birthday was overshadowed by that anniversary.
My sister was born 11-21.
