Texas is suing the U.S. Department of Education for threatening to withhold as much as $6 billion in federal funds from schools that don’t adopt “transgender” ideology.
The Office of the Attorney General filed a lawsuit Wednesday challenging the Biden Administration’s interpretation of Title IX, a federal statute enacted in 1972 to protect girls and women that prohibits discrimination “on the basis of sex” in educational institutions.
In 2021, Biden’s Department of Education issued guidance to schools expanding “sex” to include “sexual orientation” and “gender identity.”
According to the lawsuit, the new interpretation of Title IX seeks to “radically transform educational institutions” by equating sex with gender identity or “transgender” status.
The Department of Education along with Department of Justice, which are both defendants in the lawsuit, threatened to investigate schools that decline to adopt concepts promoted by the extremist “transgender” movement.
Schools risk losing federal funding if they “misgender” students, fail to use “preferred pronouns,” or maintain sex-separated facilities and sports teams.
“Texas is challenging this blatant attempt to misuse federal regulatory power to force K-12 schools, colleges, and universities in our state to accept and implement ‘transgender’ ideology—in violation of state law—by misusing the Title IX statute to threaten the withholding of federal education funds,” the OAG said in a statement Wednesday. “The Administration’s unlawful guidance could put at risk over $6 billion in federal funding that supports Texas K-12 and higher education institutions.”
The complaint notes that Biden bureaucrats are “weaponizing” Title IX in tandem with private entities like the left-of-center ACLU, which are using the federal government’s new guidance documents to intimidate school districts with threats of lawsuits as well as “provoke” the agencies to “use their powers of investigation and enforcement to pressure Texas to change its laws and policies.”
That the Defendants intend to use their new twist on Title IX to force dissenters from their new gender orthodoxy to bend the knee is no idle speculation. On December 6, 2022, the Department’s Office for Civil Rights opened an investigation into whether Granbury Independent School District had created a hostile environment for students based on “gender identity.”
It initiated the investigation based on a complaint filed by the American Civil Liberties Union of Texas which relied upon the Notice, Letter, and Fact Sheet as the basis for its allegations of discrimination.
ACLU-Texas lodged similar complaints against Frisco ISD and Keller ISD.
With Ken Paxton temporarily sidelined as attorney general during his impeachment proceedings this summer, some feared that his office might stop fighting back against federal overreach.
However, the OAG noted that this is the 50th lawsuit Texas has filed against the Biden Administration.
There was no Department of Education until the Carter Administration. I got a pretty good education in the public schools without any federal government oversight. Maybe we should abolish the Department of Education and end the federal bureaucrats meddling of children’s education.

I suggest that you research the endocrine system and it’s impact on sexual development, as well as the number of endocrine and genetic defects that can result in gender dysphoria.
People who refuse to acknowledge the reality of these documented, case studied, legitimate medical conditions (such as hermaphroditism, congenital adrenal hyperplasia, Klinefelters Syndrome, Turners Syndrome, and more) are not prepared to fight the radical agenda.

Common sense should inform Texans that that all federal funds should be abjured. Federal grants to schools tend to cost the local district more of its own money than it receives from the government and doesn’t come with inimical federal strings, or rather, chains.
Congenital Adrenal Hyperplasia = defective genes.
Klinefelters Syndrome = defective genes.
Turners Syndrome = defective genes.
What we're experiencing these days is a Fad. I think the issues revolve around, do we have to change established policies dealing with sex and gender, to accommodate that handful who have gender dysphoria?
As it relates to Scholastic sports, is it really some civil rights violation, to not allow biological males on a female team? These are the sorts of things that are being pushed on us by the radical activists on these issues.
Do we really have to allow a biological male to go in the girl’s bathroom at school because he feels he’s a girl?
All of those are very rare abnormalities and yes I know about them. It does nothing to explain what is happening to kids today, they are being brainwashed and groomed, to the Groomers, it is a RELIGION. Pre-Carter, there was Health, Education & Welfare so the federal camel had its nose under the tent before the establishment of the Education Department as a separate Cabinet position. The history of federal education funding goes back to Woodrow Wilson.

If you knew anything about my posting history, you would know that my child IS one of those kids with a rare disorder, so calling me a groomer makes you sound even more uninformed.
Believe it or not, they actually exist, are real people, and don’t run around waiving the freak flag. Further, they don’t support this radical agenda. My child thinks surgery and hormones for kids without a legitimate medical condition (usually detectable at birth except NCCAH which comes out during puberty) is lunacy.
I concur. It is statistically impossible for all these kids to be trans. My child is one of those with a rare recessive genetic defect.
Unless there is an underlying medical condition, it is brainwashing or social contagion.

I don’t support having men in women’s sports or in the bathrooms, or men in women’s prisons unless they have fully transitioned (all parts removed and they have truly transitioned). Even then, inclusion in sports is questionable since those born male have an extreme genetic advantage far and above the best female athletes, destroying women’s sports.
The number of trans-trenders out there is staggeringly high. The number of actual transgenders is less than 1/10th of 1% of the population.
Not everyone born intersexed is trans.
Those who are legitimately trans are not all on board the radical trans train. After years of trying to be seen as human beings, the radical trans movement and their insane agenda are fomenting visceral hatred towards the trans community.
