Thank you for posting jeffc.

"If the States don’t have standing, who does? Is SCOTUS saying the feds are omnipotent?"

The states have constitutional Article V amendment power to fix corrupt federal government, but are evidently too shy to use it.

On the other hand, patriots need to support Trump 47 to finish draining swamp before we mess with Constitution imo.

But once swamp is drained, a great new amendment would be one that does nothing more than repeal 16th (direct taxes) and 17th (popular voting for federal senators) Amendments, relatively little, or ideally no discussion required.

Regarding 2024 elections, it's up to us patriots to initiate the final stage of Trump 47's second term mission to finish draining the swamp by primarying as many of our beloved state and federal lawmakers and executives as we can.

After all, lawmakers and executives continue to show that they do not have the patriotism and leadership skills necessary to find legislative support for effective remedies for unconstitutional government policies.

In fact, given that one of the very few powers that the states have expressly constitutionally given to the unconstitutionally big federal government to dictate domestic policy is to run the Mail Service (most federal domestic policy actually based on stolen state powers), the worst problem that the peacetime country would otherwise be looking at with a new Congress of freshman lawmakers is a delay with mail delivery.

"Article I, Section 8, Clause 7: To establish Post Offices and post Roads;"

Trump can endorse candidates that Constitution-savvy patriots recommend as long as candidates are not incumbents, candidates also promising to repeal the 16th (direct taxes) and 17th (popular voting for federal senators) Amendments after they win office.

The definition of insanity is reelecting your beloved career state and federal lawmakers and executives over and over again, expecting those same politicians to find remedies for unconstitutional government policies every time.

If Thomas was against it, then there’s a constitutional concern.

Correct. From Article I, Section 8, comes the power of Congress to "establish a uniform rule of naturalization..." Immigration fits within this power. In the Federalist Papers, there is a lot of verbiage as to why only the federal government can do this, not the states. While it's unfortunate that the federal government has abused this power to the point of abrogating it, there is no constitutional mechanism for the states to fill the void. The 10th Amendment does not apply here.

The Supreme Court failed to notice there is no federal immigration enforcement going on it’s being halted by the Biden admn.

Appears they have accepted the fear factor of the admn.

This is consistent with every other decision the USSC has made in the matter.

states do not have standing to challenge a policy narrowing federal immigration enforcement. Justice Samuel Alito was the sole dissenting justice.

It is the task of the Supreme Court to apply the U.S. Constitution as written and originally understood and intended, to the facts of the case.

U.S. Const., Art. IV, Sec. 4 gives the states standing (illegal immigration IS INVASION) and mandates the feds PROTOETCT THE STATES from such invasion.

What the hell?

I'd sure like to know what Justice Thomas was thinking on this one. He's usually in accord with correctly applying the Constitution to a case.

Mr. Trump GET ELECTED and put BETTER Justices on the bench who will apply the Constitution as written and originally understood and intended, to the facts of the case.

And just like that, the US is over.

The U.S. has been over for a long time. This is just more manifestation of the fallout.

The states have no say?

Is that why seven states now allow illegal aliens to claim residency for in-state tuition for college?

They had to explicitly change the concept of “resident” to delete citizenship as a pre-requisite to being a resident to pull this off. Same thing with drivers licenses for illegal aliens. Those are “immigration” laws. Where is the Soopreme Clownshow on that?

"In sum, the States have brought an extraordinarily unusual lawsuit. They want a federal court to order the Executive Branch to alter its arrest policies so as to make more arrests. Federal courts have not traditionally entertained that kind of lawsuit; indeed, the States cite no precedent for a lawsuit like this," the opinion, written by Justice Brett Kavanaugh, said.

This ruling would actually make sense if we didn't have a Chinese puppet running our executive branch.

“[states can] gather them up, and transport them out of the country ... and the Feds, because of this ruling, can’t do anything about it”

The legal verbiage is over my head. Could it be that the States can do these things but they want the Federal Government to pay for it?

Did you see the term in court’s opinion “removable noncitizen”? What a euphemism!

There’s always that.

But I think there’s more to it. So many of these problems could be handled if the country had people at every level doing what is right.

Instead, down to the smallest city council and all the way up and everything in between….zoning boards school boards….it’s nothing but corruption, malice and indoctrination.

I mean, what adult thinks it’s reasonable for a book that depicts sex acts, in cartoon, and describes, in detail those acts, to be available at an elementary school? Only a sick, deranged adult with an agenda that they’re being ordered to push.

And so, IMHO, it’s up to the voters to make the necessary changes.

But the voter will continue to vote for the same corrupt POSs and shrug their shoulders, convinced that they can’t change anything, when they can.

Damn near every Republican in the House should be more like Gaetz and every Republican in the senate should be more like Paul and Johnson. Instead we get RINOs for days and are disgusted with the outcomes.

This is absurd. The federal government is a creation of the states, via the Constitution. Standing should be nothing more than a minimal bar to clear to bring a claim, in order to screen out frivolous cases, and that’s all. Instead, it has become a powerful judicial weapon the courts can use to avoid having to weigh in on “controversial” topics, or even as an impenetrable shield to block the advance of political arguments certain judges personally disagree with.

That’s what Civil War was all about. After power was seized from England, the new rulers have wanted to be kings themselves. Now, with the central Union Government, we have a hybrid oligarchy/dictatorship/faux republic with a corrupt bureaucracy.

And just like that, the US is over.

Tens of millions of Protected Class aliens will flood in uninhibited and simply lay claim to everything we have, cuz Da Soopremes said so.

It’s never been clearer why the Second Amendment exists. The founders couldn’t have made it any clearer in their subsequent writings, as well as in the Declaration of Independence. Placing one of the most important tools in the American government toolbox off limits as “unthinkable” ensures the eventual destruction of America. The reason the Second was added, aside from providing for the mutual defense, was to ensure that every other element of our constitutional system could continue to operate as intended. Without the threat of force always hovering in the background, the founders knew that it would only be a matter of time before craven evil men would corrupt the system and plunge the country back into bondage under a tyrannical government. It is IMPOSSIBLE to preserve our God-given rights and our constitutional republic without a credible and ever-present threat of force if the government should become tyrannical. To believe otherwise is to believe and trust in the inherent goodness of men, which is exactly opposite the Biblical truth and simple common sense that is the foundation of the checks and balances in our system; elements that are intended to frustrate the designs of inherently sinful and evil men.

Somewhere along the line this notion that it was unthinkable to remind the government that we will use force if necessary to keep them in line took root. But without it there is no way in the long run to preserve America’s principles and freedoms, because evil never sleeps and never stops trying to subjugate the people. We are up to our necks in the present day with evidence of this truth.

"Did the states go directly to SCOTUS or try in the lower courts first?"

Texas did. Paxton sued over Mayorkas memo, and "U.S. District Judge Drew Tipton, a Trump appointee, who ruled that Texas had legal standing to pursue the case because it could show the state was harmed when illegal aliens who should have been detained by the federal government found their way to the state and committed crimes there."

The Supreme Court reversed the decision of Judge Tipton.
