Judge Orders Release of More Mar-a-Lago Search Warrant Information in Trump Classified Docs Case
Epoch Times ^ | 7/5/23 | Jack Phillps

Posted on 07/05/2023 5:50:38 PM PDT by CFW

More portions of the federal government’s search warrant affidavit for Donald Trump’s Mar-a-Lago home can now be unsealed, ruled a judge in connection to the former president’s classified documents case.

U.S. Magistrate Judge Bruce Reinhart wrote Wednesday that more sealed parts of the affidavit that was used in the FBI raid in August 2022 “should be unsealed.” However, the entirety of the affidavit shouldn’t be unsealed, he wrote, giving the Department of Justice (DOJ) until July 13 to appeal.

In an order (pdf), Mr. Reinhart, who approved the unprecedented Mar-a-Lago FBI search, wrote that the federal government “has met its burden of showing that its proposed redactions of the affidavit are narrowly tailored to serve the government’s legitimate interests and are the least onerous alternative to sealing the entire search warrant affidavit.” It came in response to a petition from media outlets to unseal the affidavit, which he denied.

The judge, meanwhile, wrote that the Justice Department agreed in a sealed filing that some parts of the search warrant could be made available to the public. However, other portions should be sealed to meet “grand jury secrecy rules and to protect investigative sources and methods.”

It is not clear when a less-redacted version of the affidavit will be filed or how the new information will be made to the public.

Reinhart is releasing the more salacious parts of the warrant so the press can speculate for a week and ignore the White House cocaine scandal.

The cocaine scandal is to distract from the bribery scandal.

I would think it will probably help him. Yes, the usual media sources will manipulate and slant any information set out in the documents as devastating to President Trump. But sunlight usually is the best way to see what is true and what is false.

Particularly describing the item(s) to be seized and the location or person to be searched.

It’s not allowed to be a “we just want to go in and look around until we find something”. In the real law enforcement and judicial world, the affidavit has to describe the “crime”(there isn’t one), “describe what they’re looking for”(a general statement of documents isn’t cutting it...it has to be “Document ???? dated 01/01/2018 concerning ????), and describing MarALago rather specifically.

Time will tell what’s in there.

I’ve never been served with a search warrant, but don’t they give you a copy? If so, why doesn’t Trump simply release the entire thing on his own?

Not sure if that will be enough. But as long as the msm don’t put it on the morning or evening news then it did not happen for some..

serve the government’s legitimate interests

The people have NO Right to see the Truth of how we LIED and Snowed the Court with the full participation of the Judge in this matter.

He can’t unless he wants another charge of releasing “classified information”. I believe, the government’s position is that even the search warrant is classified. Heck, they don’t even want to give his attorneys their evidence before trial because they say it is “classified”. They don’t want any discovery documents to be available to the public or to let Trump release anything regarding their supposed evidence.

I’ve never in my life seen such a case in which the defense was so hobbled in putting on a defense!

“It’s not allowed to be a “we just want to go in and look around until we find something”. “

That’s the way it normally is in search warrants in criminal cases. However, it appears the government’s position is that all the usual Fourth Amendment rights have been suspended due to the “Trump exception” to those laws. Much like in every other case and accusation against him.

I’m not sure, but I believe it is because he was the judge that issued the search warrant in the first place. Trump’s attorneys are still contesting the legality of the search warrant itself and that matter has yet to be resolved.

Therefore, in the continuing litigation over the search warrant, he will continue to be the presiding Judge. That issue has to be resolved before the case can move on to the accusations regarding the retained documents.

If someone else knows differently, they can chime in and correct my thinking.

>> ignore the White House cocaine scandal.

Others are speculating the cocaine scandal is meant to overshadow something else.
