This requirement is the law. The regulations were authorized by Congress under 5 U.S.C. 301, 509, 510, 515-519.
The attorney general is the chief law enforcement officer of the United States. It is certainly expected that he would obey the law in its entirety.

This won’t satisfy the need for a special counsel… Garland obviously said a special counsel is necessary… so sometime in the future we will have one - a real one… appointed by a non communist president.

There is at least one lawyer on FR who has posted that the CFR is not binding law, but rather a set of guidelines that can be overlooked.
I would imagine that Trump would be filing a lawsuit against Jack Smith if this was really firm law.
