New Hampshire, Why Are You Doing This? (because Sununu and his minions are Never-Trumpers)

But New Hampshire is also looking into potentially barring Trump from the ballot during their primary. They haven’t established an official position on the subject, but they’re seeking legal advice, citing the shoddy 14th Amendment argument, which some legal scholars say disqualifies Trump from being president over January 6 (via Boston Globe):

A debate among constitutional scholars over former president Donald Trump’s eligibility for the 2024 presidential race has reverberated through the public consciousness in recent weeks and reached the ears of New Hampshire’s top election official.

Secretary of State David Scanlan, who will oversee the first-in-the-nation presidential primary in just five months, said he’s received several letters lately that urge him to take action based on a legal theory that claims the Constitution empowers him to block Trump from the ballot.

Scanlan, a Republican, said he’s listening and will seek legal advice to ensure that his team thoroughly understands the arguments at play.

A spokesperson for the New Hampshire Department of Justice said the attorney general hasn’t taken a position on these matters but will review the relevant legal issues and provide guidance as Scanlan requested.

Why are you doing this, New Hampshire? It’s a crock legal theory; a non-lawyer could see this opinion as anti-Trump garbage. It relates to Section III of the 14th Amendment, which disqualifies persons from public office if they have engaged in rebellion or insurrection. Oh, and these folks say a conviction isn't required to enforce this measure. So, due process can be applied in some areas and not others—isn’t that the definition of unconstitutional? Law professor Jonathan Turley took a blowtorch to this argument:

The Establishment likes to use New Hampshire as a springboard for moderate Republicanism, that is, giving moderate Republicans momentum going into the South.

But lately, moderate HAVE NOT been winning primaries (see the 2022 primaries where all of Sununu's preferred candidates lost0.

Sununu wants Chris Christie or some other Republican pantywaist to win the New Hampshire primary. So they're scheming to deny Trump being on the ballot.

But just a reminder, in 1964 Henry Cabot Lodge was the winner of the NH primary in a write-in campaign. Lodge wasn’t even running and wasn’t even in the country at the time.

If they keep Trump from the ballot, and if NH still allows write-ins, Trump will be written in all across the state.

So they can keep playing their games. They’re not going to work.

Don’t forget that Sununu’s father was the driving force in putting David Souter on the Supreme Court. Not an ounce of difference between him and the most leftist members of the Court.

Someone please make sense of this:


In New Hampshire, a person whose name was not printed on the official state primary election ballot of a political party shall not be entitled to the nomination of that party for any office unless the person received at least 35 write-in votes or write-in votes equaling 10 percent or more of the total votes cast for that party on the state primary election ballot, whichever is smaller. If a person is disqualified from a nomination in accordance with the provisions of paragraph I, then the nomination shall be awarded to the qualified person who received the highest number of votes, provided that person received at least 35 votes or votes equaling 10 percent or more of the total votes cast for that party on the state primary election ballot, whichever is smaller1.

If the Uniparty (R) pulls a second coup on Trump, the pubbies will never elect another president. If the pubbies deny Trump, I’ll write him in or not vote. I am one of millions of conservative Americans who feel this way.
