Judge orders default judgment, sanctions against Rudy Giuliani in election workers' lawsuit

A federal judge on Wednesday issued a default judgment against former Trump lawyer Rudy Giuliani and imposed sanctions on him in a civil conspiracy lawsuit filed by two Georgia election workers he had claimed mishandled ballots in the 2020 presidential contest.

Judge Beryl Howell sanctioned Giuliani for failing to comply with demands for documents and other evidence sought in the case by lawyers for the election workers, Rudy Freeman and Wandrea' ArShaye Moss.

Howell also ordered attorneys for Giuliani and the two women to propose three possible dates for trial in U.S. District Court in Washington, D.C., on the question of how much monetary damages he should be ordered to pay them as a result of the default judgment.

Are you sure Giuliani failed to comply?

He claims he complied with everything, except for the electronics that were in possession of the FBI.

I wouldn’t accept anything this partisan hack judge says or how the corrupt media report it

Depending on the details of his claim, Moore could sue Allred in federal court absolutely.

It should be thrown out for judge shopping alone.

I agree with you that this was probably some level of judge shopping. But in the US, a judge won't just throw out a case on his or her own, a defendant in a case has to ASK the court to throw out the case. In this case, Giuliani chose not to do that and instead just ignore the court. That was a weird decision.

Sorry, but I disagree... this is a civil, not a criminal matter. There is evidence that you have relavant to the case, and processes to be followed, if you willfully choose not to provide the information as ordered you are going to get a summary judgement against you.

The punishment does not suit the crime.

These sorts of judgements are more the result of *HOW DARE YOU DEFY MY POWER AND AUTHORITY!!!!!!"* than they are rational.

In disciplining workers, there has to be a series of escalations before the ultimate punishment of termination, but I see the courts can dish out this advice, but not take it themselves.

They could of course throw you in jail for contempt if they wanted, but how does that provide any justice?

How does stealing thousands of dollars from the defendant without having adjudicated the actual case provide any justice?

I remember seeing that bitch, Judge Judy, get enraged because someone had misspoken, or not remembered something perfectly, or some other alleged wrong perceived by Judge Judy, and she throws her little judicial temper tantrum and finds against whomever she perceived as having offended her.

I have long watched the courts, and they are a clown show. They don't use good logic, they don't make fair rulings, and they are more concerned with their pomp and process than they are with good results.

The plaintiff is suing you for damages, not the state trying to put you in jail for a crime...

Stealing your money is similar to slavery. The state is doing that, so I don't see a lot of difference between that and jailing you.

so if you refuse to cooperate with the court, you are almost certainly going to just lose the case and the plaintiff will get what they sued for.

And here's the thing. I don't know if he refused to cooperate, because I don't trust this bitch of a Judge's word on anything, and the fact that this is DC makes it twice as likely that she's a partisan lying bitch who doesn't give a rat's @$$ about truth or justice.

There is no presumption of honor from me regarding partisan Democrat judges in Washington DC.

This would be the end game regardless of who the judge was appointed by... you fail to follow the rules in a civil case, or refuse to show up for your trial date, expect a summary judgement against you,

Yup. Garbage legal process. I know a fellow who got a failure to appear because he was never notified of a need to appear. The Court doesn't care.

The legal system in this nation deserves nothing but contempt. It is a crapped up system ran by liars, arrogant bastards, process Nazis, and idiots.

The legal system is to Justice what witch doctors are to medicine. Just one big show but often with bad consequences.

I do not believe the truth is what has been presented to us. I believe this is what they wish us to believe so that they can feel justified in what they have done. Just like they call January 6th an "Insurrection", and make up phony charges under which to arrest Trump and prosecute him.

I would very much like to hear Giuliani's side, but my predisposition is that the bitch Judge in DC has no interest in justice, and only wants to hurt him.

Only enforced in the case of contumacious refusal to comply with valid discovery demands. I doubt that’s the case here. Discovery documents are always chronically late in just about every civil case. Imposing dismissal of the Answer and default judgment is a rare sanction.

Ted Goodman, a political advisor to Giuliani, in a statement, said, “This 57 page opinion on discovery — which would usually be no more than two or three pages — is a prime example of the weaponization of the justice system, where the process is the punishment.”

“This decision should be reversed, as Mayor Giuliani is wrongly accused of not preserving electronic evidence that was seized and held by the FBI,” Goodman said.

As I said (and you conveniently ignored) “the judgement may be fair”. But how about a straight forward judgement without all the unnecessary baggage that smacks of bias?

Along those lines she supervised the Grand Jury for Robert Mueller’s Russian election interference hoax and, despite the apparent conflict of interest, moved on to January 6 cases where she was notoriously hard on some defendants. In 2019 Howell (unsurprisingly) granted Democrats access to Grand Jury evidence in the Mueller investigation. A significant victory for the Democrats’ vendetta against Trump.

Make no mistake, assuming that Howell is an objective judge belies her history. And so I ask again do you really believe that Obama would appoint anyone who does not harbor deep seated antipathy toward Republicans?

I might have missed it but exactly when and how were these suitcase smuggling, multiple passes through the voting machine counters after hours with no seals and no poll watchers proven to not have done what they did?

I didn’t ignore anything, I said the judge can pontificate in their ruling for 1 million pages it’s all meaningless. It doesn’t change the outcome.

The pontificating has absolutely no bearing on anything… this isn’t some case setting some precident as no one will care about it doesn’t he road. The judge may think they are writing some historical document and ramble on biut it doesn’t .

It’s a summary judgement and that would happen to anyone in any case where the defendant hasn’t followed the process or complied with discovery etc.
