The suspect was armed with a taser which was used or attempted to be used by by the suspect on the cop.
In the video, you can see after the suspect was shot an object falls away from the suspect to his right.
Use a weapon on a cop, things will get ugly. It was a legitimate shoot.

I watched the video several times. I don't see the guy reach for the cop's gun as they struggle, but I can easily see why the cop might have thought he did.
The guy was flat on the ground already, so I think the main issue is that the cop could have just disengaged by standing up and backing off: which he wound up doing anyway as he shot him.
So the legal question is whether the cop has justifiable fear for his life. Maybe at the first or second shot, but not afterwards.
