A pregnant woman in Kentucky sues for the right to get an abortion

LOUISVILLE, Ky. (AP) — A pregnant woman in Kentucky filed a lawsuit Friday demanding the right to an abortion, the second legal challenge in days to sweeping abortion bans that have taken hold in more than a dozen U.S. states since Roe v. Wade was overturned last year.

The suit, filed in state court in Louisville, says Kentucky’s near-total prohibition of abortion violates the plaintiff’s rights to privacy and self-determination under the state constitution.

The plaintiff, identified as Jane Doe, is about eight weeks pregnant and she wants to have an abortion in Kentucky but cannot legally do so because of the state’s ban, the suit said. She is seeking class-action status to include other Kentuckians who are or will become pregnant and want to have an abortion.

“I am a proud Kentuckian and I love the life my family and I have here, but I’m angry that now that I’m pregnant and do not want to be,” the plaintiff said in a statement released by the American Civil Liberties Union, one of the groups backing her challenge. “The government is interfering in my private matters and blocking me from having an abortion. This is my decision, not the government or any other person’s.”

Republican state Attorney General Daniel Cameron’s office said it was reviewing the suit but offered no other comments. Cameron’s office has defended the state’s anti-abortion laws in other court proceedings.

The latest legal challenge was denounced as “meritless” by The Family Foundation, a conservative group staunchly opposed to abortion. Its executive director, David Walls, called it “absolutely absurd” for abortion rights groups to say Kentucky’s constitution “somehow secretly contains a hidden right to terminate the life and stop the beating heart of an unborn human being.”

that again? her birth control could have failed- her husband/man may have insisted on intercourse right then and there ( I know, that never happens, men are all angels,)

She can put the baby up for adoption..a parent, ANY parent all they want is a healthy child and this woman can allow this child to have a life not kill him or her

She can file a lawsuit for an abortion but can't use birth control? Men please don't lay up with these women.

If, generally speaking, men didn’t “lay up with these women” - outside of a committed monogamous relationship - the demand for abortion would be drastically reduced.


No information is given about this woman because of…privacy.

Is she married or with a partner? Is the father going along because he doesn’t have to support a child for 18 years?

These cases are designed to inflame passions on both sides, and they always succeed in doing exactly that. As little information as possible is shared with the public.

but she does not have to carry the baby, give the baby up to adoption if she does not want to, or have the laws changed?
not every baby is a wanted baby and surely you know this.
She does not feel the same as you do.

If the expectant mother [sic] was actually serious, and if anyone in her family possesses a drivers license, there is no issue. Easy, breezy, return to Kentucky in time for lunch.

If the expectant mother [sic] was a Dem activist, then you get the reason for the lawsuit.

Just had one of these “test cases” in Texas. She lost.

No, the baby lost. Lost it’s life. I wonder if this “deformed” baby had downs syndrom. In Iceland 95% of babies with Downs syndrom are aborted.

These are just folks trying to use the courts to usurp the legislature once more...

These are non starters..

Of course Ohio set the short cut that will work in most states... expect this model to be followed, but that won’t stop them from tying to use the courts too.
