Trump lawyers say court should not rush consideration of immunity in federal Jan. 6 case

Lawyers for former President Trump argued Wednesday that a federal appeals court should not accelerate its consideration of whether he is immune from prosecution over claims related to the Jan. 6, 2021, Capitol riot.

The attorneys said federal prosecutors are attempting to speed up the case so it can be decided before the 2024 presidential election.

“The prosecution has one goal in this case: To unlawfully attempt to try, convict, and sentence President Trump before an election in which he is likely to defeat President Biden,” they wrote. “This represents a blatant attempt to interfere with the 2024 presidential election and to disenfranchise the tens of millions of voters who support President Trump’s candidacy.”

Special counsel Jack Smith requested an accelerated decision in an attempt to keep with the scheduled trial date of March 4. However, Trump’s attorneys said there is no need to keep to that schedule.

*** Trump’s lawyers have consistently attempted to delay the case. If the trial occurs after the 2024 election, he could theoretically use his influence to dismiss or challenge the case if he is elected president.

“Aside from the prosecution’s unlawful partisan motives, there is no compelling reason that date must be maintained, especially at the expense of President Trump and the public’s overriding interest in ensuring these matters of extraordinary constitutional significance are decided appropriately, with full and thoughtful consideration to all relevant authorities and arguments,” his attorneys wrote.

Alongside requesting an accelerated ruling from the D.C. Court of Appeals, Smith also requested the Supreme Court review the question of Trump’s immunity given his role as president at the time of the alleged crimes.

Trump’s attorneys criticized the move, saying it prevents judges from taking their time to answer “novel, complex, and sensitive questions of profound importance.”

May the God of heaven and earth put the plagues of Egypt upon these evil doers. From the corrupt judges to the persecutors let them all reap the benefits of their evil acts. There is no way President Trump would ever be afforded a fair trial in the District of Corruption in a million years. This is a political witch hunt that is being paid for by US tax dollars.

Mark Levin said tonight that the SCOTUS should not have taken up the motion by Jack Smith, and he’s very troubled by their eagerness to do so.

Roberts trading favors and twisting arms.

That they did this shows Roberts is willing to risk it all and imprison a President for his own gratification and the expansion of the power of the Judiciary to go beyond all others.

One problem with Jack Smith’s case is that the Supreme Court will ask what dates the 3 cases (Washington DC, Florida, and Georgia) the judges in those cases will schedule their trials. If Jack Smith can’t convince the judges in all 3 cases to give the Supreme Court their schedules (and stick with those schedules), I see the Supreme Court ruling that the regular appeals proceed. Aileen Cannon is likely to tell the Supreme Court that she won’t be committed to dates and must proceed as the circumstances come. Aileen Cannon wants to be flexible.

They are asking the Court for a full hearing as a regular case. This would certainly mean scheduling it after the Election.

If Trump wins, the question will be mute. And, the Court would not have to take a stand.

SCOTUS will hear this, yet Trump's cases on 2020 election fraud with respect to inspecting cheat-by-mail-in ballots in GA that appeared to have been filled in for Biden with a machine and had no creases on the paper is still languishing in the lower courts. And recently, the word is that those ballots have been destroyed.

Ditto for Kari Lake's case of wanting to inspect the signatures on the envelopes of mail-ins in order to compare them to the signature on file. The swamp knows damned well hundreds of thousands of those signatures are bogus. Yet here we are still mired in leftist lower court defeats and delays.
