JUST IN: Jack Smith Hits Back at Trump In Scathing Respone Against Delaying Supreme Court Immunity Appeal

Last week, the Supreme Court agreed to Special Counsel Jack Smith’s request they take up the issue of presidential immunity after Judge Tanya Chutkan denied two motions to dismiss from Trump’s team, based on First Amendment and presidential immunity claims.

Trump and his lawyers responded with a filing demanding the Court wait until the lower appeals court rules on the issue.

On Thursday, Smith filed a scathing response opposing Trump’s motion, writing:

Respondent agrees that the important constitutional question in this case will require this Court’s review. But he maintains that the Court should wait for the appellate process to unfold below so that this Court has the benefit of the court of appeals’ decision. Br. in Opp. 17-21. That suggestion is misguided. The public interest in a prompt resolution of this case favors an immediate, definitive decision by this Court. The charges here are of the utmost gravity. This case involves—for the first time in our Nation’s history—criminal charges against a former President based on his actions while in office. And not just any actions: alleged acts to perpetuate himself in power by frustrating the constitutionally prescribed process for certifying the lawful winner of an election. The Nation has a compelling interest in a decision on respondent’s claim of immunity from these charges—and if they are to be tried, a resolution by conviction or acquittal, without undue delay.

Given respondent’s categorical immunity claim over every act alleged in the indictment—all of which, he contends, fall within the outer perimeter of his “official” duties, see Br. in Opp. 8, 16—this Court’s review is essential to allow this case to move forward. Only this Court can provide the final word on his immunity defense.

The government seeks this Court’s resolution of the immunity claim so that those charges may be promptly resolved

I'm not a lawyer, but if the government takes 3+ years to make an inditement why should the SCOTUS go outside normal methodology resolve "as expeditiously as possible."

As [Jerk] Smith was hired directly by current AG Merrick Garland, the correct constitutional process of appointment by the President, and confirmation by the full U.S. Senate never took place. . . . the various legal actions undertaken by [Jerk] Smith under color of law “can be taken only by persons properly appointed as federal officers to properly created federal offices. Neither [Jerk] Smith nor the position of Special Counsel under which he purportedly acts meets those criteria.

Some people may not agree with this, but I see the same things
in Jack Smith’s face, that I see in Schiff’s face.

They both have that half-crazed “mental” look to them.

Before this is over Jack Smith is going to be totally
discredited. (I know he already is to some of us, but
I’m talking broadly in the public.

Yes. Jack Smith has no standing or constitutional authority to make accusations against Trump.

He was not appointed through constitutional processes, and his "special counsel" was not approved by the President / Congress.

Unfortunately, delaying the ruling until after the election is a way for the SCOTUS to avoid having to do their job. And, that is exactly what the Chief Justice would like most.

If jerk Smith is found to be operating outside the law by not being lawfully appointed, doesn’t that open him up to CRIMINAL PROSECUTION for his Illegal Actions? And doesn’t Trump then have a rock solid case for Deprivation of Rights against every person involved?

If the Supreme Court reversed it’s fictitious “Qualified Immunity” dictate, Trump could then CLEAN ALL THEIR CLOCKS and Bankrupt every person involved..

The charges are laughable. Smith takes his assertion seriously and contends that we all should take them seriously. Smith is nothing more than a small man who thinks highly of himself.

His first mistake is thinking that his law degree actually means something. It doesn't. I have encountered enough lawyers in my life, who are some of the most stupid people imaginable. I do not consider a J.D. degree to be anything more than toilet paper.

I’m actually a little shocked at the news that Smith wasn’t already a DoJ employee when Meritless Garland appointed him. I was all but certain that was a requirement to be appointed special counsel, for the very reasons Meese cites. This seems as if MG just revived out of thin air the expired “special prosecutor” statute from the 90s.
