GOP rep warns House has final say over election after states deem Trump ineligible for ballots
The Hill ^ | 12/29/23 4:35 PM ET | BY EMILY BROOKS

Rep. Thomas Massie (R-Ky.) issued a warning to states moving to keep former President Trump off the presidential ballot, saying the House of Representatives has the final say over whether electors from those states are certified on Jan. 6, 2025.

“Maine, Colorado, and other states that might try to bureaucratically deny ballot access to any Republican nominee should remember the U.S. House of Representatives is the ultimate arbiter of whether to certify electors from those states,” Massie posted Friday on X, formerly Twitter.

Billionaire Elon Musk, owner of X, replied to Massie’s tweet about certification: “Interesting.”

Trump was declared ineligible by Colorado’s Supreme Court last week and by Maine’s secretary of state on Thursday under the 14th Amendment’s insurrection clause, pointing to Trump’s denial of 2020 election results and actions leading up to a mob of his supporters attacking the Capitol building on Jan. 6, 2021, as it met to certify electors from each state.

That normally mundane certification procedure in January 2025, Massie suggested, could be the mechanism by which Congress tosses out electoral votes from Maine, Colorado and any other states where Trump is ultimately denied ballot access.

Massie has endorsed Florida Gov. Ron DeSantis in the GOP presidential primary, and in 2021 did not vote against certifying the election results from either Arizona or Pennsylvania after the mob attack.

He elaborated in a subsequent tweet that any move to toss electoral votes in 2025 would likely depend on whether Republicans keep control of the House, where they currently have a slim majority.

“That effort [in 2021] was doomed because Democrats controlled the House and Senate at that time. Republicans hold a slim majority in the House now. Whether we keep the majority remains to be seen,” Massie said.

Massie: “Congress [could] toss out electoral votes from Maine, Colorado and any other states where Trump is ultimately denied ballot access.”

Love it! Ok, Dems, your move. What say you now?

Finally, they want to play with fire? Let’s give them what they want! Good and hard!

[Massie] elaborated in a subsequent tweet that any move to toss electoral votes in 2025 would likely depend on whether Republicans keep control of the House, where they currently have a slim majority.

For reference, the 119th US Congress will meet from January 3, 2025, to January 3, 2027. Electoral votes will be formally counted January 6, 2025 before a joint session of Congress.

So what I glean from this is the Dems will pull out every stop possible to cheat in the Congressional election of the HOR to avoid the House tossing electors from states keeping Trump off the ballot.

>“That effort [in 2021] was doomed because Democrats controlled the House and Senate at that time. Republicans hold a slim majority in the House now. Whether we keep the majority remains to be seen,” Massie said.

Democrats had a majority of House Reps then, but I don 't think they had majority control of a majority of state delegations then. Which how House voting to break electoral college non-decisions is done under the 12th. IIRC GOP had a potential couple vote lead available, presuming no anti-Trump GOP defections affected the pre-voting within state delegations. But how much of the potential votes in a House overseen election squabble are done under those less familiar state voting rules and whether some are done under the more familiar individual rep voting rules I don't recall for certain. In spite of what Massie now asserts and my agreeing that Dems had more Reps, my recollection from Jan '21 was that purported experts were saying that IF Trump could somehow maneuver to send the election to Congress: for the House to vote on President and for the Senate to vote for VP, that President. Trump + VP Harris was a possible outcome. Just how to maneuver to send the decision to Congress was the hard part, requiring either GOP members to make some challenges—at least some were willing to do that—but which potential votes the J6 protest were used to quash, or for Pence to act as a Trump card rather than a Biden card.

Judging from the erudite comments critiquing Bellows for dumping Trump,
on themainewire.com, I’d say she is working the wrong side of the street.

@the watcher posted on themainewire.com:

Bellows ballot dumping is a direct violation of the equal protection clause of the 14th amendment.

As a state officer, she is required to carry a surety bond, and she personally can be sued for this violation.

The insurance company that issues this bond is likely to tell her that she is on her own;
she has made this ruling, not on a due process court ruling, but of her own volition.

Any town officer that violates the rights of the citizens can face the same reprisal.

First off it will be a miracle if the the republicans survive to JAN 2025 with the enhanced vote fraud machine. Secondly even if they do then won’t do a thing to stop it. Including rejecting electors. Too many Rino infiltrators.

good luck with that.

Law was changed in 2022.
The number of members required to make an objection was raised from 1 in each Chamber to one-fifth of each Chamber.

A state’s certificate of vote can be rejected only if both Houses of Congress vote to accept the objection via a simple majority.

Can the VP break a tie ? if they are not on the ballot ?

What is this insane Twilight Zone world we live in where we have one party accusing a candidate of interfering in an election while THEY interfere in an election??

And let’s not forget the Russia collusion HOAX which of course they want to forget.

They all KNEW it was a lie, the FBI said the dossier was BS, but they went ahead with the fake investigation ANYWAY in an attempt to scam the public and remove their right to a fair election. Not ONE person has been brought to justice yet for that, especially the vile Hillary

If the Supreme Court punts, and I hope it doesn't, it is possible that eight other Northeastern states, the West Coast states other than Alaska, Illinois, Michigan, Minnesota, and New Mexico will follow suit in disqualifying Trump. In total, 17 states at a minimum will not allow Trump on the ballot. This will invite retaliation, first by very red states like Idaho, Wyoming, Utah, and Oklahoma then by most Southern States, Virginia and Georgia excepted. The Plains states and maybe Missouri, Indiana, West Virginia, and Ohio will follow, disqualifying Biden from the ballot based on allegations of bribery and failure to control the borders. So at least 17 states and maybe 21 will prevent Biden from being on the ballot. Thus, a clear majority of states will prevent voters from choosing either Trump or Biden.

A Presidential election like that will mean that neither side will recognize the winner. The Deep State may want this to happen, even if it triggers a civil war they believe they will win. They may be going full Lenin.

If removing DJT from the ballot and somehow preventing write-ins does not work, there is only one thing left to the vile Dems to keep DJT from the Office of The President ...

Watch the Dems in the 2024 election do the very thing they accused Trump of advising Pence to not certify the election of 2020 of Trump wins.

The guy is a dope. He’s laying out a scenario that will never happen in Congress.

If the GOP had any interest in dealing with the nonsense in Colorado and Maine, they would have had every Democratic House member in these two states stripped of their committee assignments immediately.

If these state governments want to meddle in national politics, then make them pay the price for their folly.

Isn’t this what the “ insurrection” was trying to say?

That vote fraud should not have been state-certified

The letter after the name means jack anymore.

The only reason political parties still exist is to give voters the illusion of choice.

A pol is either loyal to our former republic or to Deep State.

Congress is Deep State’s.
