Supreme Court to hear Trump challenge to Colorado ballot removal next month

The Supreme Court will decide whether former President Donald Trump can be kept off state presidential ballots after the Colorado Supreme Court found he had violated the Constitution’s so-called “Insurrection Clause.”

In a brief order Friday evening, the high court announced it will hear arguments Feb. 8 in the 77-year-old’s challenge to the Centennial State ruling, which temporarily removed from the state’s March 5 Republican primary ballot.

With voters already casting ballots in primaries and caucuses across the country by the time the case is heard, a decision is likely to follow quickly.

The Colorado decision, handed down Dec. 19, had cited Trump’s attempts to overturn the 2020 election results that led to the Jan. 6, 2021, Capitol riot as proof that he violated Section 3 of the 14th Amendment, which bars those who have violated their oath of office and “engaged in insurrection” from holding high office again.

In an appeal filed Wednesday, Trump’s attorneys had argued that “[i]n our system of ‘government of the people, by the people, [and] for the people,’ Colorado’s ruling is not and cannot be correct.”

“The question of eligibility to serve as President of the United States is properly reserved for Congress, not the state courts, to consider and decide,” the filing added.

People keep talking about Trump being guilty of “insurrection”. That is a very specific charge, and no prosecuting attorney has brought this charge against Trump to any grand jury ANYWHERE, there is no indictment, the facts have not been heard in court, there has been no ruling of guilt or innocence, and there is no sentence that was ever handed down.

How many ways can anybody say “nothingburger”?

The Court's schedule here is very fast. Petitioner is basically given two weeks to submit its opening brief, and respondent is given two weeks to submit its responsive brief. That's a brisk schedule.

The Supreme Court is not going to decide any case, much less a case like this, without briefing from the parties. And, of course, the Court didn't have to take the case at all.

USSC Will punt. They will rule that Trump hasn’t been found guilty of insurrection and secondly, he has not been elected to the office - - thus, nothing to litigate right now.

Which will leave the door open to further litigation, once elected, if he’s found guilty of insurrection.

I have $0.12 which I’ll bet double or nothing on

The Supreme Court was created to decide cases like this. It’s their job. They have a moral obligation to take it.

I could go in front of the Supreme Court and get the judges to rule 9-0 in favor of Trump..its this simple..the definition of an insurrection is trying to overthrow the Govt, Trump was president til Jan 20th..so they are saying that Trump tried to overthrow HIMSELF..that is laughable..and secondly the other side will say “Well Trump wanted to make sure the election was not certified” lets say that is 100 percent true, even if the election had been certified, Trump could have sat down in the White House and said “Im not leaving” period end of story..drag him out kicking and screaming he isn’t leaving..the whole idea that Jan 6th was an insurrection is an absolute JOKE when Trump didnt even need to do that, could have just said “Im not leaving” so what are they going to do, drag him out..fine give it your best shot

For the sake of this country I sincerely hope they overturn the Colorado and Maine blocking Trump from the ballot. If they fail to do so, either by not taking the case or postponing it indefinitely it will lead to most blue states banning Trump from the ballot and a majority of red states banning Joe Biden.
