Police chief says while case is 'unusual,' clerk's arrest was 'about the law'

A store clerk who allegedly used a baseball bat to hit a man who attempted to rob his convenience store is now facing a charge of aggravated assault, Peterborough police say.

In a news release issued Tuesday, the Peterborough Police Service said officers were called to a convenience store in the King Street and Bethune Street area around 2:30 a.m. on Jan. 5.

Upon arrival, officers learned that a male clerk was helping a customer when a second man entered the store demanding money and brandishing a baseball bat, according to the release.

"A struggle ensued and the clerk was struck with the bat before grabbing the bat away from the suspect," police said.

"The suspect then fled the store. The clerk followed the suspect out of the store and struck him several times with the baseball bat on the sidewalk."

Arrest warrant issued for 37-year-old suspect

Police said the man who allegedly attempted the robbery suffered head injuries and is in a Toronto hospital receiving treatment, while the clerk was treated at the scene by emergency medical services.

A warrant for arrest was issued for the 37-year-old man who allegedly attempted the robbery for assault with a weapon, possession of weapon, and robbery, police said.

Meanwhile, the 22-year-old clerk from Peterborough was also arrested and charged with aggravated assault. He was held in custody and appeared in court on Jan. 6.

Peterborough police say they would also like to speak with the male customer who was in the store at the time of the incident...

IF somebody tries to beat you with a baseball bat, and you get that bat and beat on them... Sounds like a reasonable case of self defense... Not a case of assault.

No. This is not about the law. Now if the perp is a sex worker in his underwear swinging a hammer at 2:00 AM and the clerk is in his underwear in a dog collar.....you might be ok?

the canadian argument is the perp left the store after his bat was taken away... street justice says pursue and beat the MF with his own petard...

but in canada... i feel for the clerk.

That’s the problem. If I were the clerk’s lawyer, I’d “remind” my client that the suspect made threats to kill the clerk, and it sure looked like the suspect was turning around.

And I just looked it up. You have the right to remain silent in Canada. So that, too.

It’s always an open question whether the police would care very much about a robber robbing a convenience store. I mean, the police aren’t really there to enforce the law. Their job is to act as secretaries and fill out paperwork after a citizen gets robbed.

BUT

If the citizen is able to defend himself and disable the robber, NOW it’s about the law and that citizen is going to get what’s coming to him, good and hard.

Good for the clerk.

Let him walk.

Use a Billy Club. It’s just a tool for restraint. I would love hearing police chiefs go after assault charges for using a Billy Club to protect yourself. You know, the same one cops beat people with?

Every cop swhould be armed with a billy club or a baton to subdue arrest evaders. A lead black jack should be available to silence whining defense lawyers who raise brutality charges against the cops who’s civil rights were violated by the criminal

The same law is in effect in the US.

Once the villain is fleeing, you can not attack him with any weapon.

People have been put in prison in the US either because they did not know or “lost it” and did not care.
