Democrats are burning up vast amounts of money to stop Trump looks like it’s going to be futile even democrats voters are stunned at the courts actions.

Trump lawyer Alina Habba said she was unaware Manhattan federal Judge Lewis Kaplan and Carroll’s lawyer Roberta Kaplan worked together in the early 1990s at the same powerhouse white-shoe law firm

How on earth did she not know this?

But it's not like it was top secret. Certainly someone of Trump's legal team could've did some basic background investigation. What's he paying these people to do?

This is basic stuff. Defense 101. Maybe he should hire lawyers who are pitbulls instead of hiring lawyers who have a great set of tits.

The Elements of a Malicious Prosecution Claim

Courts generally agree on the elements required for a malicious prosecution claim. But some states combine elements or arrange them differently. The six elements of this claim are as follows:

The institution or continuation of a civil or criminal legal proceeding against the plaintiff;
Done by, or abetted by, the defendant (the prosecutor or plaintiff in the malicious action);
Termination of the prior proceeding in the plaintiff’s favor. For instance, the case brought by the prosecutor or plaintiff in the malicious action was dismissed;
Absence of probable cause for instituting the prior proceeding;
Malice as the primary purpose for the prior action; and
Injury or damage to the plaintiff as a result of the prior action

-A lawyer for Donald Trump on Tuesday backed off her suggestion that the judge who oversaw E. Jean Carroll’s two successful civil defamation trials against the former U.S. president might have had a conflict of interest.

In a letter to U.S. District Judge Lewis Kaplan in Manhattan, Trump’s lawyer Alina Habba said she was satisfied that the judge and Carroll’s lawyer Roberta Kaplan, who is not related, did not have a “mentor-mentee relationship” when they worked at the same law firm three decades ago.
