I would take both sides with a grain of salt.
They may have enough info here to figure things out. If the level of intoxication was such that they couldn't consent, per OAS standards it's rape. The Bahamas will put them away for that. As to the State Dept warning, that seems to be irrelevant. State warned about gang related criminal activity, which this probably wasn't. Perhaps the tapes will clear that up. Lousy publicity for the Bahamas. The civil suit will go on for quite awhile presuming they try to blame Carnival.
