If I was the judge and wanted my ruling to be appeal proof, I would attempt to give the DA as much of the benefit of the doubt as possible and “force” the other side to more than win their case.

I wouldn’t immediately rule - I’d wait a week or two to “carefully consider” the evidence multiple times, etc., etc.

Will DA appeal? Yes. But if the judge conducts himself the way he’s doing (skeptical), imo his ruling to disqualify will pass any appeal effort.

That’s why I think McAfee is ocassionally playing devil’s advocate and making sure the defense attorneys lock in their arguments with airtight case sites, Rules of Professional Conduct, the county codes. etc.
