Supreme Court's Alito pauses Texas law on illegal border crossings

U.S. Supreme Court Justice Samuel Alito on Monday temporarily blocked a judicial decision that would let a Texas law take effect to give state officials broad powers to arrest, prosecute and order the removal of people who illegally cross the border from Mexico.

Alito issued his order - requested by Democratic President Joe Biden's administration - after the New Orleans-based 5th U.S. Circuit Court of Appeals on Saturday paused a federal judge's ruling that had blocked the Republican-backed Texas law.

His order is set to expire on March 13 but he or the full Supreme Court could take further action before then. Alito handles certain emergency matters involving cases from a group of states including Texas. The 5th Circuit ruling would have permitted the measure, known as SB4, to go into effect even as Biden's administration presses forward with a legal challenge claiming the statute unlawfully interferes with the federal government's enforcement of U.S. immigration laws.

The 5th Circuit stayed its decision for seven days to give the administration a chance to appeal to the U.S. Supreme Court.

The Justice Department filed a petition with the Supreme Court on Monday arguing that the 5th Circuit's decision was wrong and that letting the law take effect would harm the U.S. relationship with Mexico and other countries. "And beyond its disruptive foreign relations effects, SB4 would create chaos in the United States' efforts to administer federal immigration laws in Texas," Justice Department lawyers wrote.

If Alito had not acted, the law would have taken effect on March 10 pending an appeal of last week's decision by U.S. District Judge David Ezra in Austin.

As I frequently note, there is a difference between being a conservative and a federalist. Conservatives want the U.S. to have secure borders and don't care who does that job. Federalists like open borders if POTUS decides to ignore the law. Alito is a federalist. I may start an Anti-Federalist Society soon, but I am a bit busy lately.

How?
The reason Texas moved on this, is because the Federal government wasn’t, and isn’t enforcing U.S. immigration laws.
I don’t see any interference whatsoever.

Alito is right whether you like it or not. Texas can’t supercede federal law on immigration. Immigration is a federal issue.

That being said I’m glad Texas and Gregg Abbott are doing exactly what they’re doing because they’re forcing the issue and it’s a brilliant move on Abbott’s part. That’s also why you don’t see Biden doing anything about it.

The main issue here is Biden, Mayorkas and the rest of his administration IS NOT following law and needs to be held accountable.

We definitely don’t need any new immigration laws, we need enforcement of the laws on the books. The “comprehensive immigration reform” is a pure BS on both sides.

For all we know Deep State has some or all of the SCOTUS under house arrest.

That would explain a lot.

Something else to think about...

Even if Trump somehow manages to win in a landslide too large for Deep State to steal...

Deep State will still have control of Congress, the SCOTUS, and the bureaucracy.

Uh, that is misleading right there because there are no efforts to admnister federal immigration lawsin Texas. Presidential orders and under that table administrative direction in contravention of statuory law is not "administration of the law."

Yes.

Are there any other federal laws that local and state officials are not allowed to enforce? Conversely, are there federal laws that state and local officials can then ignore? BATF, EPA, DEA, education, DHS, HHS?

That rests upon, the stability of principals. Know a principal = likely having an understanding of laws, related.

An American citizen can enforce laws, and normally we do, by requiring our government agency employees to faithfully do the work.

But you could enforce the law, by following procedures - the same as a "law enforcement agent." You would be taking on a lot of responsibilty, and YOU MUST keep detailed notes every step of the way.

A judge for the jurisdiction, needs to see those notes of your activities and findings.

If you are a federal agent, you can enforce local law in good faith that you demonstrate in person and on paper (recorded).

If you are a local law enforcement agent, you can enforce federal law in good faith that you demonstrate in person and on paper (recorded).

Usually, you do not take such steps unless a law enforcement agent (or agents) are not on the scene. And when you do take such steps, it is wise to hand over the processing to the lawful agent(s) who show up.

Your burdens increase, the deeper you go into an other jurisdiction. Your burdens increase, if you are a private citizen trying to do the right thing.

Whatever, find out, What is, the right thing to do. Be prepared.

Now, regarding Texas, or any state of the Union. All have the right to protect their borders and land and private property - especially when the federal government fails to do its duty, particularly in the event of an emergency *declared by the state.*

Now, regarding Texas, the federal government has clearly failed to protect and defend the border and the state and neighboring states. The Biden Administration has clearly defied Constitutional obligations - its officials have clearly defied their duties.

The position of Texas is that this is not immigration but an invasion, and the States do have authority to protect themselves from invasion.
