Following last month's verdict, Mann vs Simberg and Steyn moves on into its thirteenth year and the appellate phase ...oh, no, sorry, we've still got some post-verdict maneuvring to attend to. On Friday, my counsel filed three motions at the District of Columbia Superior Court. If, as with baseball cards, you're anxious to collect the set, they are:

a) a Motion to Stay Execution ...wait, wuh? Nobody said anything about execution. Relax, it's merely a Motion to Stay Execution of the Judgment;

b) a Motion for Judgment as a Matter of Law; and

c) a Motion for (gulp) a New Trial.

I need this like I need the proverbial hole in the head - which, to be honest, I'd prefer, were it not for the fact that, as one of the lawyers sneered to me last autumn, "this doesn't end with your death". So, in the interests of not saddling my heirs and relicts with Mann vs Estate of Steyn, I push on against the advice of my (non-American) doctors.

If you're wondering about the broader non-personal rationale for these motions, well, re the stay of execution (foot of page two):

The $1,000,000 punitive damage award is unlawful for multiple reasons.

So incredibly messed up. They will come for us. Once they get to us, they won’t stop until the completely destroy us. Pick us off one by one, then two by two, etc.

Steyn and Trump have nerves of steel and icewater in their veins. Utterly untlappable. I hope they prevail. I can’t believe public money is being spent to such extremes to engage them in such partisan lawfare.

Mann has sued the Competitive Enterprise Institute and Mark Steyn for libel, under the legal theory that he should not be subject to “public figure” rules, because he was “an involuntary public figure.”
