Supreme Court chief justice denies ex-Trump aide Peter Navarro's bid to stave off prison sentence

WASHINGTON (AP) — The Supreme Court on Monday refused to halt a prison sentence for former Trump White House official Peter Navarro as he appeals his contempt of Congress conviction.

Navarro is due to report Tuesday to a federal prison for a four-month sentence, after being found guilty of misdemeanor charges for refusing to cooperate with a congressional investigation into the Jan. 6, 2021, attack on the U.S. Capitol. He had asked to stay free while he appealed his conviction.

Navarro has maintained that he couldn’t cooperate with the committee because former President Donald Trump had invoked executive privilege. Lower courts have rejected that argument, finding he couldn't prove Trump had actually invoked it.

The Monday order signed by Supreme Court Chief Justice John Roberts, who handles emergency applications from Washington, D.C., said he has “no basis to disagree" with the appeals court ruling, though he said the finding doesn't affect the eventual outcome of Navarro's appeal.

His attorney Stanley Woodward declined to comment.

I was wondering if it was the entire court or just one, now we know it was Roberts.

It’s so discouraging. Used to be you had hope with the courts but not so sure we have any hope at this point. Between this and denying Texas the right to defend its border it looks like SCOTUS might be in on the coup.

Trump must improve on the follow through of procedures That is also what he missed re the security of documents: What he claims to have done re certain files, needed to be marked accordingly.

A President is under no obligation to do so!

Just the act of taking the documents out is enough to show declassification.

Must the president follow any specific declassification procedures?

The answer is a resounding no for two reasons. First, Executive Order 13526 on its face contains no such declassification procedures.

The Order sets forth (1) who may declassify information and (2) what standards they should apply, but beyond that, there is no additional process required.

While both individual agencies and the Information and Security Oversight Office have developed additional rules about how declassification should be carried out, none of these procedures apply to the president.

Second, given the president’s constitutional authority over both classified information and the administration of presidential executive orders, even if Executive Order 13526 did establish constraints, they are at most self-constraints that the president has the power to ignore.

The J6 committee was totally a sham. It is a disgrace that DOJ persecuted Navarro who going to do time for refusing to testify. I hope Trump visits biblical ruin on these bastards.
