Arizona Supreme Court rules that a near-total abortion ban from 1864 is enforceable

PHOENIX — The Arizona Supreme Court ruled Tuesday that a 160-year-old near-total abortion ban still on the books in the state is enforceable, a bombshell decision that adds the state to the growing lists of places where abortion care is effectively banned.

The ruling allows an 1864 law in Arizona to stand that criminalized abortion by making it a felony punishable by two to five years in prison for anyone who performs or helps a woman obtain one.

The law — which was codified again in 1901, and once again in 1913, after Arizona became a state — included an exception to save the woman’s life.

That Civil War-era law — enacted a half-century before Arizona even gained statehood — was never repealed and an appellate court ruled last year that it could remain on the books as long as it was “harmonized” with the 2022 law, leading to substantial confusion in Arizona regarding exactly when during a pregnancy abortion was outlawed.

Misleading headline and article. If the law was modified in 1913 (to include an exception for the mother's health), then don't call it an 1864 law.

It'd be like if a state last year modified a law against murder to no longer include the death penalty, then a leftist wrote an article saying it's an old law because for centuries it's been illegal to murder people.

I'm getting an uneasy feeling that the RINO state supreme courts in battleground states are wanting to help Democrats in the November elections.

They make an abortion ruling in two shakes of a lamb's tail, yet Kari Lake's election integrity lawsuits are still mired in the leftist lower courts.

They just have to drive to NV. It’s been in the Nevada Revised Statutes since the early 90’s up to 26 weeks or later if the doc says. Don’t think it will get reversed anytime soon.

When pharmacists decided during the recent unpleasantness that their fellow humans shouldn’t be permitted to get their hands on Hydroxychloriquine or Ivermectin, they had no trouble avoiding filling those prescriptions....

That would be correct.

Arizona is ruled by suburban women. Look at the government.

And a lot of those Republican women are still stuck in the ‘70s. So they will be incensed by this. Vote for Biden? Maybe not. But they may stay home.

And the baby murdering harpies will come out in droves.

Why does the 1913 law have to be harmonized with the 2022 law? Shouldn’t the 2022 law have to be compliant with the 1913 law? It may just be semantics.

Oh yea, Trump has them scared. Thr only thing they have to get out the vote is abortion. Trump’s stance doesn’t guarantee that a strong pro sbortion group votes for Biden on the question of President.

This looks like a victory but it will just push the initiative to get abortion on the ballot in Arizona. Looks like the signature drive already has it there.

BTW this will keep Arizona blue politically, this is a dimrat wet dream.

And from what I understand some pharmacists are still refusing to fill those Ivermectin prescriptions.
