Yes, courts only rule on what is asked of them. In this case, it appears to be Arizona Republican politicians as noted below.

US Supreme Court ruling paved way for return of 1864 law
The abortion ban first codified in Arizona law in 1864 has been sitting on the books for 160 years.

First appearing in the 1864 Howell Code, a book of laws compiled by Arizona’s First Territorial Legislature, the state’s abortion ban was similar to those in many states. It was enforced vigorously in Arizona until the Roe v. Wade decision in 1973.

For almost 50 years, legal abortions were considered a fact of American life, until the Dobbs v. Jackson Women’s Health Organization ruling in June 2022 that removed the Roe protections.

The ruling by the new, more conservative U.S. Supreme Court, spurred Arizona Republican politicians to ask the courts to lift the injunction from 1973 and allow police and prosecutors to enforce the 1864 law. The new court action had the effect of renewing Planned Parenthood’s 1971 legal fight.

The Arizona Supreme Court recognized all that was unsettled in implementing its 14-day stay before the 1864 law can be enforced. That window allows any legal challenges that were started in 1971, but essentially put on hold because of Roe v. Wade, to be pursued again now, over 50 years later.

Mayes said her office was weighing its response. The state’s top court sent the case back to the original superior court to consider the possibility of further action.

“My office is, as we speak, discussing what our next steps are, whether that is appealing this decision to the United States Supreme Court, whether that is taking ... the constitutional questions that remain, back down to the Superior Court,” Mayes said.

He thinks that. I don’t. It will matter some. It will be offset by the illegal criminal invasion, making the economy the deciding factor in President Trump’s favor.

Plus, AZ has moved from 2.8% registration advantage in 2020 to 5.3% now. And the R margin has grown every month.

The last and most recent federal execution was of Dustin Higgs, who was executed on January 16, 2021. On July 1, 2021, Attorney General Merrick Garland announced that a moratorium on the federal death penalty was being reinstated.

If this were 2004 Id agree but Kari Lake just responded to this and I think Trump should use the same line. This is not where Arizonians are, Im calling on the Govenor and the state legislature to immediately pass legislation to get the law more in line with Arizonians. This is why we are happy this is a state issue, we no longer need to wait 20 years for Washington to figure it out, we can fix it tomorrow.

The beauty of this is, you NEVER have to say what the fix is, you can constantly call on the Govenor and the legislature to fix it and because you have a big voice the suburban women who want attention get it and can say, see Trump even gets it (remember, you never have to solve anything, sign anything, take responsibility for anything or even suggest a solution).Just call for a solutoon constantly then pivot back to the border. Media says something, call on the legislature to fix it. Demagogue this to death.

Wrong. Trump need only call on the state legislature to fix the problem, say it over and Over. I am calling for immediate action by the Govenor and the state legislature to get the law in line with Arizonians, this is completely unacceptable! The great thing about this being a states issue is it never has to be solved by the President. He can demagogue the issue. The Govenor is asleep on this issue, I am calling for her to immediately call a special session to get this law in line with where Arizonians are! Be a cheerleader for the fix (while never saying what the fix is). Then, pivot back to the border. This is the problem we have, whether it’s the border or Abortion, the government is refusing to act! Give them a master class in demagoguery.

I call on the Govenor to immediately convene a special session to get this law in line with where Arizonians are! The state legislature and the Govenor need to come together and not leave until thia issue has been fixed. This is outrageous!

The other question is why the AZ supreme court, which is sure to be a full mix of Dems and MAGA hating McCain style republicans, decided to take up a case on their 1864 abortion law.... just now?

Because it works in the Democrats' favor.

There will be a pro-abortion ballot initiative in 2024 that will drive pro-abortion voters to the polls and possibly cost Trump Arizona.

Had they sat on it or ruled against it, it would have muted the momentum.

The Arizona Supreme Court Website has fact sheets on case of interest. In this case, it is 4 pages long and outlines the history going back to 1864.

After Dobbs overturned Wade v Roe, the then Republican Arizona Attorney General Mark Brnovich asked the court for relief from the 1973 stay following the Roe Ruling. On January 2, 2023, Kris Mayes assumed office as Arizona Attorney General, thereby succeeding Brnovich as a party but with an opposing viewpoint to Brnovich’s.

On August 22, 2023, the Arizona Supreme Court granted Dr. Hazelrigg’s Petition for Review as well as Yavapai County Attorney McGrane’s Motion to Intervene and Join Dr. Hazelrigg’s Petition for Review. The case was set for supplemental briefing and oral argument.

The question before the court was this:

A.R.S. § 13-3603 forbids any “person” from performing an abortion at any time “unless it is necessary to save” the mother’s life. Did the Arizona Legislature repeal or otherwise limit this statute by later enacting Roe-era laws like SB 1164 that forbid certain physician-performed abortions while expressly (1) refusing to repeal § 13-3603; (2) creating no right to an abortion; and (3) making no unlawful abortion legal?

What effective approach do you recommend?

1. Build your pro-life campaign around the core message that legalized abortion in the U.S. was instituted by Democrats and wealthy white Republicans to control the black population.

2. (And this is the hard part) ... Promote abortion as a great public policy to control the population of Democrats -- whoever they may be (black people, liberal white suburban women, Jewish voters, etc.). Highlight all the "blue" states in recent presidential elections, and promote abortion in these particular states as a way to reduce the political influence of Democrats on our national political scene. Build the movement around this slogan: "Aborting Democrats is an investment in the future of this country."

Watch how quickly the narrative changes when this happens.

I appreciate your reply.

The first one is, of course, true and could easily be inserted into campaign materials.

The second one .. needs to be presented as something the DEMS push/promote. As in The Democrats appear to consider abortion as a ‘great public policy to control Dem populations....’ then, highlight the blue state stats. Otherwise ... they’ll turn it around that the Rs wish this upon the Dems.

But, just where/how, exactly, would you ‘promote’ this? We know the MSM won’t allow this to be aired. AND ... actually, not sure they’d even allow the first one to air. They’ve denied ads, before.

Does that leave *airing* on social media?

We know platforms like Youtube ... who happens to allow a cringeworthy Briben ad, before every vid I’ve viewed, in the past few weeks, won’t allow anything like this.

It is past time to take the gloves off, on this, with FACTS/stats.
