Stabbing on the Apple River: Defense rests after defendant Nicolae Miu's testimony

HUDSON, Wis — Nicolae Miu's defense rested Tuesday after the defendant took the stand in his own defense.

Miu, 54, is charged with one count of first-degree intentional homicide and four counts of attempted first-degree intentional homicide for a deadly stabbing spree that took place on the Apple River on July 30, 2022. Prosecutors say Miu pulled a knife during a confrontation with people from two separate groups, fatally stabbing 17-year-old Isaac Schuman of Stillwater and wounding four others, one of those victims nearly dying as well.

Miu's legal team called the explosion of violence a clear case of self-defense, saying Miu was surrounded by more than a dozen people who were screaming, taunting and physically attacking him.

Closing arguments will heard Wednesday. The jurors will be allowed to consider lesser charges, at the request of the state.

IMO, it would be reasonable to bring manslaughter charges, but it was self defense. Not sure how it could possibly by murder 1. Miu did not handle the situation ideally before and after the confrontation. He stabbed five people, threw the knife in the river, and did not tell people in his party what happened. He told the detective he took the knife from one of the attackers when he really got it from his pocket.

However, he was surrounded by several people and was hit, choked, and knocked into the water. He was beat up afterwards. They were in better shape, he was outnumbered like 10-1, and he had a heart condition. The fact that he stabbed five people indicates there were 5 people at close range.

The person killed had a blood alcohol level of .21 and the others injured were also legally drunk. The "victim's" friend admitted taunting Miu and said "when you hit a girl, there are consequences." Miu indicated he pushed away a girl, and then they started punching him.

It seem like he used the knife in self defense. That if he had not used it, he could have been badly beat up, and maybe killed from the blows, drowned, or died of a heart attack or stroke.

The prosecution asked them to consider lesser charges. I don't see how it could possibly be murder 1. It wasn't premeditated. Hard to see how it is even manslaughter. It isn't exactly how I would have handled the situation, but it seems like clear self defense.

I don't know why they prosecuted that way. Not a lawyer, but I don't see how a magistrate found probably cause. A grand jury usually does what the prosecutor wants, but don't see how they indicted him for murder 1. Maybe the prosecutor wanted to make sure Miu pleaded not guilty and there a big TV case to promote his political career, etc. Or maybe he was under political pressure or pressure from the kids' parents.

Not only would I vote for acquittal, I’d encourage him to sue every one of those lying witnesses.

Yes, he lied to the cops after the fact about the knife and them having knives, etc. But that was after the facts of what actually happened. Every one of those witnesses were a living testimony to what is wrong with our country. A bunch of drunken hooligans, who will lie, arrogant young fools who are nauseating in every way.

He, a hard working humble likeable successful man, an immigrant from Romania, who speaks better Romanian than English......who was beat, assaulted, called a child molestor and was obviously, very confused and afraid.

Sounds like typical Wisconsin "justice". A bunch of drunken pukes ganging up on an older man and the system sides with them. Just like what happened to that Hmong guy some years ago in roughly the same area. Politically climbing young DA.

Those kids got what they deserved. The kids in the group harassing him come off really badly as witnesses. They testified they were drunk and high. Sure, they never expected to get stabbed. The defendant does not seem like the kind of guy to get into physical fights or draw a knife unless he was afraid for his life. He was hit and choked and surrounded by 10 people calling him names. He probably didn’t handle the situation perfectly, but it is still self defense.

When someone stabs someone in a fight, it is never charged as premeditated murder. If it was a one on one fight, and the defendant started the fight, maybe 2nd degree murder. It wasn’t like Miu planned to start a fight as and excuse to stab people. Prosecutor maybe thinks any publicity is good publicity, and is fine with looking like a jerk on TV.

Granted the young crowd was likely intoxicated, but the defendant has a rather unbelievable story claiming he was in the water looking for a lost cellphone. A cellphone lost in a river would be not worth retrieving and almost impossible to find unless you knew exactly where it was dropped. He also would have been hampered in his search by the crowd floating in the river and could have waited until they passed. The young people concluded that he was in the river to ogle the young girls and likely over reacted to his presence getting into a shoving match with the defendant. They were unarmed and he could have retreated, but he chose to use his knife. Definitely manslaughter.

Yeah, you could make a case for manslaughter. I agree, it is a shallow river, but it would seem hard to find a cell phone dropped in the river, and it might not be usable anyway. So they probably thought he was there to ogle the girls. He maybe could have gotten away from them when they started calling him names.

Once he started stabbing, he maybe had to keep doing that, as at that point he could get hurt badly if they responded.

I watched the testimony of the “best friend” of the “victim”, the girl who got stabbed, and the black guy in the other group who filmed it. The defendant comes off way better than any of those.

If I am ever outnumbered 10:1... Damn right I’m taking as many of them with me as I can.

Mui was looking for a dropped cell phone... Kids thought he was being a creeper and in their drunkeness decided to pick on what looked like easy victim.

17 with a BAC of .21? That’s heavy lifting even for an old Marine like me...

Newer cellphones are a lot more water resistant and EXPENSIVE. Some are even covered by water damage warranty’s... but you need the phone to file a claim.

I would have gone looking for the phone too.
