Not funny --is it?-- that the Speech or Debate Clause. that keeps congresscritters out of jail is the tenant denied the majority of J6ers.

“Near” is the key word. They lose that immunity if they are trying to unlawfully violate the civil rights of citizens, as they most certainly did.

Sorry, All Claims of Immunity for anyone are no longer Valid since the Constitutional Immunity afforded the President are no longer Valid. ARREST, HOLD WITHOUT BAIL AND PROSECUTE, Fight every last motion and NEVER let up. JUST LIKE THEY ARE DOING. When all else fails, Declare them as Enemy Combatants and lock them up in Club Gitmo./

I see several ways around that.

(1) Have a GOP House repudiate their immunity based on violation of Congressional ethics and then have the Trump II Department of Justice prosecute them. Sure, they are likely to win in the end, but bedevil and bankrupt them in the meanwhile.

(2) Fashion criminal charges of conspiracy based on associated conduct, like their destruction of evidence or suppression of testimony.

(3) Call them to testify before Congress and then prosecute them for any lies they tell. Since they are Democrats, they seem likely to tell quite a few whoppers under oath.

But they know what they did was just a circus proceeding. What they’re really worried about is that the same might be done to them. I don’t believe for a moment that there wasn’t anyone that wanted the result to be prison. What if the roles were reversed, they know somebody would be trying for that even if doesn’t end up happening.

They’re just scared the other team will do what they did.

I don’t know. It would seem that there was collusion along with intent. I don’t know if that could survive legal scrutiny, especially with how much the judicial system loves to interpret and expand upon the original intent of legislation.
