Law claims "dual citizenship" exempts church probe, defends decision

BOSTON (AP) — Cardinal Bernard Law, answering an attorney's questions under oath Wednesday, maintained that he relied on the advice of doctors and subordinates when he approved the parish transfer of a priest accused of sexually abusing children.

The deposition was ordered in a civil lawsuit accusing Law of negligence in supervising a pedophile priest John Geoghan whose case helped trigger the church's sex abuse crisis.

The Archdiocese of Boston had settled with the 86 victims who accused Geoghan of sexual abuse for an estimated $15 million to 30 million, but it backed out of the settlement last week. A judge ordered the deposition be held immediately.

Law, who has withstood repeated calls for his resignation from people who say he has mishandled the sex abuse cases, arrived at the downtown courthouse amid heavy security.

The closed-door deposition opened with his attorney, Wilson Rogers Jr., making a standing objection to the questioning, saying "the inquiry into the inner workings of the church was inappropriate."

Under questioning, Law explained that he was both a U.S. citizen and a citizen of the Vatican, of which he is, as a cardinal, technically a "prince." He said he only recently learned of that status.

"But I must say that it hasn't been something that I've been conscious of in the past 17 years," Law said, according to an 88-page transcript of the morning session, released by attorneys for the plaintiffs.

It had been suggested Law could have diplomatic immunity from civil lawsuits because of his dual citizenship with the Vatican.

William Gordon, an attorney for the plaintiffs, challenged Law about why he approved Geoghan's transfer in 1984, even though he had received letters and other evidence of abuse by Geoghan.

Law said he didn't recall reading letters warning about Geoghan's behavior — including one from his own secretary — and that doctors said Geoghan was not a threat.

"I'm sure that medical assurance was given," Law said. "Whether it was subsequently put in writing and in an earlier form given orally, I cannot say. But I can say, without a shadow of a doubt, that this letter would never have been put before me for a signature had we not had the assurance of someone competent to give that assurance that this assignment was safe."

He acknowledged, however, that the archdiocese had no written policy on handling allegations of sexual abuse by priests at the time.

Geoghan is currently serving a 9- to 10-year prison term after being convicted of raping a boy. He has been accused of molesting more than 130 children.

The deposition of Law is a legal rarity for someone of such high church ranking.

He isn't a diplomat. He doesn't have diplomatic immunity. And if he has dual citizenship, then he is a citizen of the US. As a citizen of the US, he ought to fall fully under US law.

If Rome wants to 'extradite' him as a citizen of Italy, then he should have his US citizenship revoked and be barred from ever returning to this country.

Exile may be less than what he deserves, but it would be better than nothing.

Here's the understatement of the year. Law wasn't aware that he was a prince of the church for the past 17 years.

What a disgrace.

By the time the dust settles, expect two things:

1. The traditional U.S. Catholic Chruch will be bankrupt.

2. There will be a new U.S. church, a la the Church of England, which will, over the next 50-75 years, get the majority of members who are today members in name only of the U.S. Catholic Church.

If he has dual citizenship it is the US and the Vatican City state, not the US and Italy. The Vatican is a sovereign state.

Okay, if anybody buys this concept, I've got a plan. I'll buy some pathetic piece of rock from some island nation, and with their approval become an independent nation. I'll sell citizenship to whomoever wants it and confer whatever title of nobility they want.

Then those people can go commit whatever crimes they want in the USA and claim diplomatic immunity. Any takers?

You can carry dual US-Canadian citizenship, I believe. I think the US has agreements with certain countries that allow holding both citizenships, but not with all countries.

Used to be. But it was changed under pressure from the Israeli and Irish lobbies. So American Jews can get Israeli passports and Irishmen can get themselves declared "official."

Now, of course, the takeover of the Southwest will be facilitated, with dual citizenship Mexicans being encouraged to continue voting in Mexico.

It was muy stupido to change the law. It was better the original way -- when you become (or are) an American, you give up any other loyalties.

His dual citizenship is American and Vatican not Italian. He is a prince of the sovereign state of Vatican City and does have diplomatic immunity should he choose to assert it. As a Catholic, I prefer that he not claim immunity but face not just the music but the full symphony.

It's perfectly legal. Daniel Pearl had dual Israeli/US citizenship. Two of my brothers were born while my family was on assignment outside the US. They have dual citizenship.

It's far more common than most people realize.

On the other hand, each and every actual believing Catholic will stay put, remain Catholic and cheer the exodus of the AmChurch liberals. The American style Anglican Church already exists and is bleeding members in a major ongoing hemmorhage.
