and how the defense has something they are holding back on that's as good as a confession. Kim, my understanding is the defense wants that info kept under seal even through any appeals if there is a conviction. Doesn't strike me as exculpatory evidence for DW.

This is how I read this. (But I may be wrong) It appears that Westerfield may have said something "nearly as explosive as a confession." If this got out before his trial was over, he would be convicted on this alone and appeals would then be futile.

Supreme Court Ruling

The defense attorney told the judge he had received an e-mail from the U.S. Supreme Court, informing him that his appeal was denied regarding the unsealing of certain statements made by Westerfield to police.

Feldman had argued before a different judge that the statements should remain sealed because they were obtained illegally.

----------------------------- Ok, I misunderstood the first time..but I thought he was insinuating that it pointed to a third party..MAYBE IT'S HIS SON?? It's still seems like it's pointing to someone else..he just didn't want to be forced to use it right?

My reading on this is...it's explosive as a confession would be....but not towards DW.....it is unimpeachable evidence towards someone.....they do not want this info out until/if and when he should get convicted and lose his appeals.

Sounds like he is protecting someone but only wants it used if all else fails.

Sounds more like they want to drive me crazy trying to figure out WHO he could be trying to protect ? WHO he would go though all this in order to protect? WHO,WHO,WHO,WHO????
