I'm no genetic engineer... but isn't it quite simple to identify sex by checking chromosomes? Can't this case be easily dismissed by forcing the MAN to take the test?

Not in the case of people who are born with an XY chromosome pair but female physical body (sexual organs, etc). Or would you classify them as "men" regardless?
