The home schooling battle in California has brought to the forefront Delaine Eastin, the Superintendent of the California Education Department.
Delaine Eastin has sparked a national reaction to her recent letter stating that parents who homeschool their children are criminals. After facing local and national scrutiny, she then sent a letter to the California Legislature, claiming that home schooling is illegal, demonstrating her unwillingness to back down.
Her allegations were shot down by another letter sent to the California Legislature, from the Home School Legal Defense Association, which affirmed that "California’s Education Code expressly recognizes parent-operated private schools as a legal alternative to public schools."
The HSLDA letter also explains that the case law that Delaine Eastin and the Californian Education Department are relying on is hopelessly out of date compared to recent precedents and a "1998 amendment that expressly recognizes that parent operated-private schools are legal."
In the face of such overwhelming support for home schooling, Delaine Eastin has not relented.
Perhaps her record can explain her behavior; for four terms beginning in November 1986, Eastin served in the State Assembly, representing 20th District. This district is extremely liberal and contains portions of Alameda and Santa Clara counties.
In 1994 Delaine Eastin ran for the California Superintendent office. The office is a purely political office like a legislative seat or the Governorship. In 1998, she employed the Staton & Hughes campaign agency in her successful reelection bid, which raised three million dollars. Eighty five percent of the three million raised was in five hundred-dollar or more contribution, casting a shadow on her supposed schoolteacher personal.
When Delaine Eastin - a career politician – decided to run for reelection in 1998, she attempted to revise her career. According to a Knight-Ridder/Tribune News Service article from 1998, Delaine Eastin hasn’t taught school since 1979. Although she was a state assemblywoman and then a state superintendent, she tried to "change her ballot designation from superintendent of public instruction to teacher/state superintendent."
However Delaine Eastin is now nearing the end of her second term; the November elections are coming up soon. In California, the law dictates that a state Superintendent may only serve two four-year terms in office.
Some critics believe that Delaine Eastin may be attempting to use this to try to hinder home schooling, something she knew would not be politically expedient until she was nearing the end of her time in office.

i met him at a party at my friend's offices just before the last electoral farce, when barbara tuchman (sp?) was running against the yellow running dog leftist, delaine eastin.
so, i cozied up to him, and asked: "well, what do you think about barbara tuchman?"
his reply?: "who?"
literally, he wasn't even aware that there was someone else to vote for in the election.
i know that a lot of freepers are a lot more law-n-order than i am, but, seriously, if you were sitting on a jury that was trying me for strangling him then and there, what would you do?
