You'll notice that this purported 1845 War Department document is not further identified. Of course, the War Dept hasn't always published stuff in tune with bona fide American policy and law. For example, there was a fuss in Congress circa 1928 when it was found that the War Dept had churned out a civics textbooks for the troops that democarcy sound really evil. The article that started this thread seems to use the word "prove" very carelessly.

One important clue is that the Bioren & Duane 1815 edition of the Constitution, in its version of the TONA had Americanized spellings (like "honor") and had no dates of ratification or adoption but the original engrossed copy, including the copies sent to the State legislatures and printed in the Annals of Congress, had British spelling ("honour") and most editions of the Constitution that were worked up independent of Bioren & Duane show the dates for the various amendments; so Americanized spelling and an absence of dates shows a reliance on Bioren & Duane.

Why do you naysayers deny, and dismiss as tinfoil, the possibility that similar intrigue could have occurred in the 19th century---a struggle between those with divided loyalties, and undivided loyalties to this country---and that the "missing 13th" could be the artifact of that struggle?

Because what actually happened (mistaken edition of printed edition, and then publishers copying the mistake in later printings-which happens all the time in publishing) makes so much more sense than a conspiracy by all political parties and the media to "forget" an amendment. Occam's razor.
