There is something about a "fair trial" in this context that doesn't feel quite right.
It is too early in the morning to put my finger on it.

Immigration fraud?
The Social Contract?
The noble "suicide pact"?
War by other means?
Sun Tzu?
Selling them the rope with which to hang us?

Not sure what.

No person shall ... be deprived of life, liberty, or property, without due process of law ...
