The same way they can pass a law that says you get treated at an ER even if you don't have money. The nanny state can make the rules if the people want the nanny state.

Yep. Everyone's for "free" medical care.

But when the government tries to reduce their medical costs by mandating seat belts or helmets or BAC, suddenly we have this fascist state.

Get off the government teat, then you can have your freedoms back.
