Although I'm not positive, I believe the difference is in the language of the law, which has to do with gratification--performing sex acts for the purposes of gratification, etc.

At least in my state, this is what prostitution requires. I would guess, then, since my fine state of Indiana is not a porn-industry mecca, that since the "actors" and "actresses" in porn videos are not performing sex acts for the purpose of gratification, then that allows them to escape the prostitution charges.

This, though, is only a guess.

Of the few porn movies I've seen, it seems that each and every guy was 'gratified' so to speak. That gratification usually get special attention by the filmers too.

You are right though it's got to be some lawyer double speak to see any difference in the two.
