The Supreme Court has unanimously ruled that unborn children have no rights in the Irish constitution apart from the right to life, as enshrined in the Eighth Amendment.
In a landmark judgement, the seven judge court this morning overturned a decision made by the High Court last summer that an unborn child has rights in law beyond the constitutionally protected right to life. This ruling removes a significant obstacle in the governments plans to hold a referendum on repealing the Eighth Amendment in late May.
Wide implications
The High Court decision involved a Nigerian man in a relationship with an Irish woman, who was seeking Irish residency on the basis that he was the father of her unborn child. Mr Justice Richard Humphreys found that unborn children, including the baby of a parent facing deportation, enjoys significant rights and legal protection at common law, by statute, and under the Constitution, going well beyond the right to life alone.
Determined to remove rights from the unborn
The State sought and secured a fast-track appeal to the Supreme Court against these findings, which could have derailed or delayed its plans to hold a referendum on repealing the Eighth Amendment and giving the Oireachtas power to legislate abortion.

I dont understand. The High Court decision seems like it gives the unborn a lot of rights. Is that a different court?
“The High Court decision involved a Nigerian man...”
Christ.
Ireland killing babies is beyond sad.
Yes, overturned by Supreme. 1st sent, 2nd para.
Within 3 generations Ireland will have no abortions because it will be under sharia law which does not allow abortion.
“The Supreme Court has unanimously ruled that unborn children have no rights in the Irish constitution apart from the right to life, as enshrined in the Eighth Amendment.”
This makes no sense. Here’s how I interpret the Court’s decision: apart from the 8th Amendment thatt enshrines an unborn childr shall have a right to liffe, the same child nevertheless has no other innate rights, and ergo may be snuffed out before they enjoy a single breath of life. But isn’t the righ-to-life guarantee all that matters?
So only a government can assign the luxury of life - and forthwith may remove the privilege as well on a whim. Jesus, please come soon
Ireland lost forever...
You still can't legally kill unborn babies in Ireland... at least for now.
And why can't these supreme court members in Ireland see the difference?
Failte isteach Sharia !!!
In just a matter of a few years Ireland has gone from one of the most conservative catholic nation on earth to a leftist cesspool. What happened?
The right to Life
Is the greatest of battles
It may seem a trifle
But this battle is all
Once Ireland joined EU, it’s been on the downward path to hell.
You’re asking rhetorical questions. You know what happened.
The global collectivists don’t just stick to acting locally.
I was confused as to whether the High Court and Supreme court were the same thing.
Thanks for clearing that up.
I was wondering why the same court reversed itself!!
The first sentence of this story renders the title a lie. I stopped reading pretty much there.
How ironic, I am now coming home from a St. Patrick’s Day parade right now.
