But, who knew that "mother" would be a political word? Good post. It seems to me the über-feminists made "mother" a political word when they ran them out of their own homes and away from caring for their children by shaming them. Abortion was the method to keep them out.

I fail to see why - if the fetus is understood to be a human being - abortion should be left up to the states. Isn't murder a federal crime?This is not a criminal law. It's a regulation of medical procedures. In theory the federal government has no jurisdiction over such matters unless interstate commerce is involved. Then they can regulate because of the interstate commerce clause of the constitution. So to have a constitutional basis for this law, they connected it in some way to interstate commerce. This clause has been abused by liberals - including judges - over the years to have the federal government intrude on states' rights. Liberals like Ginsburg have stretched the clause to ridiculous lengths to justify such intrusions. In this case, she'll probably say the interstate commerce clause doesn't apply.

Just wanted to get your 2¢ on this, but it looks to me as if
the SCOTUS is headed for a collision course. What I mean is that PBA ban is going to force them to
define a fetus as a full human being which will give it "equal protection" under the 14th amendment. However, Roe v. Wade
gave MOTHERS this same "equal protection", so we have a conflict.
IMHO, The Honorable Senator Santorum, Brownback, et. al. were very clever to make PBA only apply if the head (or torso in case of breach birth) was fully out. This forces the court to address the human/fetus issue. Yeah, I know they wrote it per the problems from the 2000 case and right-to-life lawyers were upset, but it's necessary strategery...
The SCOTUS is going to be stuck because Roe v. Wade will look the same as allowing murder to be legal in some states, but illegal in others. Thus, they won't be able to overturn Roe v. Wade, i.e., return the abortion issue to the states. Houston, we have a problem!! Solution: some kind of rushed Constitutional amendment? There's serious trouble brewing!! Hip hip hooray, but watch out!!

SCOTUS is going to be stuck because... Also gonna be stuck because the only way to overturn this legislation is to say that the Interstate Commerce Clause doesn't apply. If they do this, it'll set a precedent to subject all past, present, and future legislation to this same scrutiny... which would be a good thing! It's win-win either way for Conservatives, life, and liberty!
