We seem to feel comfortable with the indefinite detention of someone with an Arabic name. However with the passing of more and more restrictive laws, the continuing erosion of our freedoms, more and more people will react in a way that would be construed as terrorism. Soon it will be you're regular John Smiths that are locked up indefinitely and their 'terrorist activity' may be nothing more than protesting outside of a free speech zone.

I really don't care it they have an Arabic name or not. If someone is arrested inside one of the 50 states of the United States of America, the Constitution gives no "wiggle room" on how they are to be tried. It is very clear on how we must proceed with their trial. There is no provision for indefinite detention.
If you are a citizen, captured outside the borders of one of the States, the Congress may decided where your trial may take place.
Treason, both inside and outside our borders is punishable as decided by the Congress, but still requires a trial.
All others captured outside the borders of the 50 states are pretty much at the mercy of the military, which is ultimately under the jurisdiction of the Congress but under the immediate supervision of the Commander in Chief.
However, Article 1, Section 8, specifically states that tribunals constituted by the Congress are inferior to the Supreme Court.
I find no place where the Commander in Chief is authorized to constitute tribunals.

That is a very broad brush you are using there. Btw, those prisoners held at Guantanamo Bay are the worst of the worst Al-Qauda terrorists and are you confortable that the Supremes have now given them a free ride to the media circus called the "US Justice SYSTEM"?

How about lawyers sympathetic to their cause acting as go-betweens to the terror cells? Heck even in Israel the terrorists have no qualms with their RED CROSS collaborators and using the ambulances to smuggle arms and terrorists.
