Explain to me again why we don't do loser pays?

Good question. Instead of dozens of ways of attacking the Trial Lawyer industry over the past years (limiting damage amounts for most lawsuits, etc.) and nibbling around the edges of refom - perhaps chucking all these “fixes” and pushing through some “loser pay” rules in as many states as possible would be a better way to go.

Eight years ago at least Bush was paying lip service to tort reform. It’s 10,000 beneath the surface of this campaign. Why don’t we have reform? The bar has the country in a death grip. No transaction can take place unless they get a piece of the action and the’d be nuts to let that good deal get away from them.
