Howard’s small business was the target of an enormous lawsuit that could have forced him to close his doors. His offense? A wild Canada goose nesting outside his store startled a passerby, causing her to fall. Two years later, Howard was served with papers announcing that the woman was suing Contemporary Watercrafters for $750,000, alleging that the goose was the store’s responsibility. Ironically, Howard had wanted to remove the goose from his property long before the accident, but, because it was protected under the Migratory Species Act, the bird could not be disturbed.

Sounds to me that his offense was not buying a simple CGL.

He shoulda killed and cooked the goose so his goose wouldn’t get cooked. An alternative to that would have been, of course, to shoot, shovel, and shut up. All these envirowhacko laws should be repealed.

We were sued for several million dollars by a then current Air Force One pilot whose wife we'd let in our house to prevent him shooting her down in the streets.

I'm still not done with this one ~ he is, but I'm not.

Stupid judge who let that one slip through should have been impeached, removed from the bench and then hanged in front of his family.

The good news is that Americans are growing tired of paying for these abusive lawsuits.

The bad news is that Democrat politicians love them. Trial lawyers are among their biggest donors. And the press is very unlikely to take this up as long as it is working for the DNC.

Certainly most Freepers hate these abusive trial lawyers. And I'd love to be able to drop my expensive excess liability policy. But it will be a tough fight, and we just lost a round when Hussein got elected.

Can this lawsuit be deferred to algore due to the absence of global warming? Apparently the goose didn’t get the memo that he/ she should stay put since we’ll no longer have winter.
Or, can the shopowner defer the suit to whomever said geese are protected species?
This keeps getting more ridiculous....

These problems could all be solved by judges, but I'm sure the answer will be that we need more laws, because things have gotten to the point where almost every single proposal in government is sinking the country further.

In our parish, a boy was hit in the head with an ice ball. The parents sued and settled.

Problem was, the kid was at a Youth Group Meeting. He is the son of the Youth Group Leader who let the kids go outside and play in the snow.

Nice.

It’s stories like these that warms my heart knowing that we have two lawyers about to take control of the Presidency/Vice-Presidency.

I’m sure he had a CGL if he was a business owner. If he did not, he should fire his insurance agent and his attorney and his financial advisor.

What were his allegations? What was his theory of liability? What was his cause of action?

You don't need that stuff to file a lawsuit in Virginia. The big deal is you put blue paper on the notice of service.

It's the judges.

Your excess liability coverage should cost less than your primary liability policy, unless you have real high excess limits.

You don’t need diddly squat to file a lawsuit anywhere, but unless you can plead a legitimate cause of action it will get tossed real fast.

All these envirowhacko laws should be repealed.

They should've been repealed during the last administration when the Republicans controlled congress (along with a very large agenda of other issues we should've taken care of when the Republicans were in power).

Shoulda, coulda, woulda. Ain't gonna happen now.
