MEMPHIS, TN - (WMC-TV) - A Shelby County grand jury has returned an indictment against Memphis City Council member Barbara Swearengen Ware, District Attorney Bill Gibbons announced Friday.
According Gibbons, the indictment stems from an investigation into allegations that employees in the Shelby County Clerk's Office accepted money in exchange for registering vehicles without proper documentation.
The indictment alleges official misconduct. According to the indictment, Ware registered or renewed the registrations for vehicles that had not been inspected a total of eight times between 2002 and 2009.
"As a result of her elected office, the indictment, in essence, alleges that she illegally obtained a benefit not available to some 200,000 other vehicle owners in Memphis who obeyed the law by incurring the time and effort to have their vehicles inspected," Gibbons said.
Though the indictment was returned in October, Ware was not arrested until Friday. For the past several weeks, she has been hospitalized after receiving a pacemaker. Gibbons said his office was unable to discuss the indictment until after her arrest.
Ware was released late Friday afternoon.

Is she a Democrat?
One cannot tell from the article.
Surely an oversight by the author.
Time for another fun round of “Guess that Party!”
Yep. I knew it!
I live in the area. I know Bill Gibbons is a R, never heard of the “lady”.
The great great grand daughter of Deadwood’s own Al Swearengen?
An elected official doing the renewals and only eight times. Very odd. Not much payola for a vehicle registration. Very odd indeed.
Can I have a “D” Pat?
No party == 99+% chance of being a democrat.
Barbara Swearengen Ware used to be Barbara Swearengen Holt. She is a democrat (surprise).
She’s from Memphis and she is in the city council. Of course she is a Rat.
Hopefully, this is a felony.
And even worse is that she could be convicted and sentenced to 20 years in jail and STILL be re-elected. The mentality among blacks in Memphis is "We're in charge and we are going to steal as much from the city as we can get".
In Memphis politics, it is a resume enhancement.
Technically, I think Memphis/Shelby County is non-partisan in city and county elections but we all know who they vote for.
