Gillibrand: Some can’t distinguish between a ‘slap on the ass and a rape’

Sen. Kirsten Gillibrand (D-N.Y.) on Tuesday said some military commanders can’t “distinguish between a slap on the ass and a rape.”

Gillibrand made the comment during a hearing where military leaders made public their opposition to Gillibrand's legislation that would strip commanders of the power to decide where sexual assaults are prosecuted. The New York senator wants prosecutors to decide where such crimes are tried, not commanders.

“While you are all so dedicated and determined, not all commanders are objective,” Gillibrand said. “Not every single commander necessarily wants women in the force. Not every single commander can distinguish between a slap on the ass and a rape.”

Gillibrand argued that sexual assault victims are afraid to report the crimes out of fear of retaliation from their commanders.

“You have lost the trust of the men and women who rely on you that you will actually bring justice in these cases,” Gillibrand said. “They’re afraid to report. They think their careers will be over. They fear retaliation. They fear being blamed.” ......

Forget the sarcasm tag? It’s the military, not a social club or a church. A good percentage of military members, both men and women, use foul language and joke explicitly about sexual matters. That’s not the same thing as inappropriate physical contact or rape. I’d prefer if they behaved like saints, but that’s not very realistic given American culture these days. Besides, the military exists to win wars.

Another F’n farce to use in the trashing of the military.

The number of reported abuses has risen. The number of verifiable and prosecutable (even in civilian courts) abuses has not really risen over the years.

False reports for various reasons has been going on for many years. I knew two individuals back in the 70s who were falsely accused, courts martialed and their lives ruined, prison time. In both cases their accusers later recanted and confessed to fraudulent reporting. Nothing happened to the false accusers and it took over a year to finally release each of them. In both cases they were accused because they had declined to continue a relationship with the women in question and the “scorned woman” revenge quickly followed.

I also knew of one guy charged and there was no doubt about his guilt. He was thrown out and into a military prison for many years. He truly was a dirtbag and deserved what he got.

Enough of this crap, it has been going on for too long (the baseless accusations that gain traction).

20 plus years ago I predicted this... had a small incident that today could have gone horribly bad ...

P-3 Patrol 100 deg, 100% Humidity 45 min Preflight ... we take off I do my Integrity check report to the Pilot ... we had a female Flight Engineer Observer (Guest... it was a Checkflight, not a Mission) ...

After reporting to the Pilot I informed the female to keep her eyes forward as I needed to go to the back of the a AC and change into long johns and a dry flight suit. (It’s cold at altitude but we were also going to Maine)

No problems, nothing said during, post or on the return trip ... the day after we return I’m up on charges.

1 week later all Charges dropped and lil mis visitor was not ever invited back. This could have been a lot worse if the CO, XO and Command Master Chief were not involved... that’s what the folks that wish to have “outside authority” determine harassment charges.

If I hadn’t had 3 witnesses it may not have went as it did... as it was my Wife had to get involved and that is the part that ticked me off most, we were deployed often and she did not need that seed of worry.

Easy Solution to our current situation “NO Women in Combat... Period” (Support or Stateside kool).

Leave the UCMJ and how it is enforced alone.

Soldiers Sailors and Marines never have been saints throughout history. It is not a result of today’s culture.

I served with many women over my career. I married a Woman Marine over 40 years ago. We both knew women who made or threatened guys with false accusations of rape. Many more who could outcuss any male Marine and who would talk about anything in any company.

As an AF officer I served with several female officers who had no qualms about talking about their sexual conquests and the men they’d had, unsolicited and in mixed company.

Historically it has been the same for soldiers. As noted in Kipling’s poem “Tommy” — Why, single men in barricks don’t grow into plaster saints —

But when the heat is on —

For it’s Tommy this, an’ Tommy that, an’ “Chuck him out, the brute!”
But it’s “Saviour of ‘is country” when the guns begin to shoot;

F**k the democrats, their party, their Fuehrer.

Hm...although I disagree with this approach, it would probably shut up a lot of liberals, feminists, and democrat communists. Might just be the way to go.

All this uproar about commanders overlooks an important consideration. One of the most important reasons for courts martial is to enforce discipline. That reason doesn't exist in civilian courts. Commanders must have the authority to convene CMs, and to review their findings.

I was once the senior officer on what amounted to a CM. Enlisted man was caught in a drug bust by civilian police. His Air Force job was handling bombs. The enlisted guys on the court wanted to hang him, although that wasn't a possibility. The ultimate decision by the court was a dishonorable discharge. Under the regs we didn't have any choice. It was that or a slap on the wrist. The convening commander reduced the punishment to general discharge. I thought it was a good decision on the commanders part. It was a civil crime, and the guy would be punished in a civilian court anyway.

Both stories illustrate the point; that false charges can and are occurring. This degrades performance and ties up resources.

The Military has a function and it is not PC.

How can we do our jobs if the threat of harassment overhangs operations.

(not to say it shouldn’t be guarded against and prosecuted)

In the early 80’s I had a young E3 go to a “long lunch” with another sailor (I’m thinking a male but not sure). She came back bragging about how nice the room in the Holiday Inn was where they had their “lunch”.

So I casually commented that I would like to have those kind of long lunches at home since all my kids were in school.

I was at the time a Chief.

With incredible speed I was being counseled by the Command something or other who’s job was to ensure equality of the sexes. Evidently I was sexually harassing the poor thing.

Needless to say, little miss screwing every day at lunch never got counseled but she sure as hell got moved to another part of the base.

Glad I retired when I did...

While I was in, we had High Standards of conduct, our Flight Chief covered our backs, but when it came down to it, they washed out those that could not perform.

tolerance for abuse (drugs or otherwise) was Zero.

The big plus to an all volunteer force was quality (overall)
draftees, didn’t want to be there, so they escaped any way they could.

Nature of the Beast (so to speak)
